Քիչ առաջ տեղեկացանք, որ այսօր կրկին կալանավորում են զենքի մատակարար Դավիթ Գալստյանին՝ Պատրոն Դավիթին։ Հիշեցնենք, որ ԱԺ քննիչ հանձնաժողովի նիստի ժամանակ՝ օգոստոսի 1-ին, Անդրանիկ Քոչարյանն էր առաջինը հայտարարել, որ Պատրոն Դավիթին կրկին կալանավորելու են եւ նա անմիջապես ներկայացել էր ԱԱԾ մեկուսարան, որ դիմակավորված ԱԱԾ-ականները չգնան իր տուն։ Սակայն ՔԿՀ-ում նրան ասել էին, որ իրեն կալանավորելու որոշում չկա, իրենք ոչ մի փաստաթուղթ չեն ստացել եւ վերջինիս կալանավորելու որեւէ հիմք չունեն։ 

Դրանից անցել է 23 օր։ Պարզվում է՝ Անդրանիկ Քոչարյանն «ուղիղ կապի» մեջ է դատարանների հետ եւ նա Պատրոնին կալանավորելու մասին իմացել էր մեղադրյալից, նրա պաշտպաններից (գուցե նաեւ դատավորից) շուտ՝ հիմա նոր «թղթերը հասել են» մեկուսարան եւ Պատրոն Դավիթին կալանավորելու որոշումն իրագործվում է։

Սակայն ամբողջ բանն այն է, որ այն գործը, որով պատրաստվում են կալանավորել Դավիթ Գալստյանին, վաղեմության ժամկետն անցել է, եւ օրենքը չնայած չի արգելում քրեական վարույթ իրականացնել՝ քննություն կատարել եւ այլն, մանավանդ եթե մարդն արդարացում է պահանջում, սակայն արգելում է կալանավորել մարդուն։ Քանի որ անգամ եթե այդ անձի մեղքը հաստատվի, դատարանը որեւէ պատիժ չի կարող սահմանել՝ վաղեմությունն անցած մեղադրանքով։

Ի՞նչ են արել իրավապահները՝ ինչ որ անօրինական ֆոկուսով «ջրել» են վաղեմության ժամկետը՝ իբրեւ թե այդ գործով վաղեմության ժամկետը չի անցել։ Իսկ կալանավորման համար հիմք են ընդունել իբրեւ թե վկաներից մեկի նկատմամբ գործադրված ճնշումը, սակայն այդ վկան էլ անցնում է Գալստյանի մյուս գործով եւ ճնշման փաստն էլ ապացուցված չէ։

Մի խոսքով՝ գերխնդիրը Պատրոն Դավիթին կալանավորելն է, անում են։
