Երևան քաղաքի դատախազությունը, պետական (համայնքային) շահերի պաշտպանության հայց հարուցելու լիազորության շրջանակում, ուսումնասիրել է Երևան քաղաքի Հրաչյա Քոչար փողոցին հարող տարածքում գտնվող բենզալցակայանի վերաբերյալ փաստաթղթերը։

Ուսումնասիրության արդյունքում պարզվել է, որ վերոնշյալ բենզալցակայանի նկատմամբ 2002 թվականին Անշարժ գույքի կադաստրի պետական կոմիտեի պաշտոնատար անձանց կողմից գրանցվել է ՍՊ ընկերության սեփականության իրավունքը:

Ըստ սեփականության իրավունքի վկայականի՝ գրանցման հիմքում դրվել են Երևանի քաղաքապետի՝ պետական սեփականություն համարվող հողամասը վարձակալությամբ տրամադրելու մասին որոշումները, ինչպես նաև հողի վարձակալության պայմանագրերն ու նախագիծը:

Նշված պայմանագրերով՝ վարձակալին թույլատրվել է վարձակալած հողամասի վրա իրականացնել շինարարություն, սակայն դրա նկատմամբ վարձակալի կողմից սեփականության իրավունք ձեռք բերելու վերաբերյալ նշում առկա չի եղել: Գործող օրենսդրությամբ, սակայն, վարձակալված հողամասի վրա վարձակալի կողմից կառուցված շենքի նկատմամբ սեփականության իրավունք կարող էր գրանցվել վարձակալության պայմանագրում ուղղակիորեն նման հիմք նախատեսված լինելու պարագայում:

Արդյունքում, իրավական հիմքերի բացակայության պայմաններում, Կադաստրի կոմիտեի կողմից կատարվել է սեփականության իրավունքի գրանցում, ինչի հետևանքով էական վնաս է պատճառվել պետության շահերին:

Ուսումնասիրությամբ պարզվել է նաև, որ բենզալցակայանի զբաղեցրած հողամասն ընդգրկված է Հողային օրենսգրքի 60-րդ հոդվածի սահմանափակումների ցանկում (օտարման ոչ ենթակա տարածքներ):

Նկատի ունենալով, որ ուսումնասիրության ընթացքում հայտնաբերվել են Կադաստրի կոմիտեի պաշտոնատար անձանց կողմից առերևույթ հանցանք կատարելու դեպքեր՝ Երևան քաղաքի դատախազության դատախազը 2024 թվականի հունվարի 23-ին հանցանքի մասին հաղորդում է ներկայացրել Հակակոռուպցիոն կոմիտե։

2024 թվականի հունվարի 25-ին Հակակոռուպցիոն կոմիտեում նախաձեռնվել է քրեական վարույթ՝ Քրեական օրենսգրքի 441-րդ հոդվածի 1‑ին մասով (պաշտոնեական լիազորությունները չարաշահելը)։

Դատախազությունը, պետական (համայնքային) շահերի պաշտպանության հայց հարուցելու լիազորության շրջանակում, 2024 թվականի փետրվարի 1-ին հայց է ներկայացրել Վարչական դատարան՝ պետական սեփականություն հանդիսացող գույքը պետությանը վերադարձնելու նպատակով:
