Օտարերկրյա պետությունում վճարված եկամտային հարկի դրույքաչափի գերազանցման վերաբերյալ պարզաբանում

Պետական եկամուտների կոմիտեն, հաշվի առնելով ՀՀ ռեզիդենտների կողմից ՀՀ սահմաններից դուրս ստացված եկամուտների հարկման թեմայի վերաբերյալ հանրային քննարկումները, անհրաժեշտ է համարում ևս մեկ անգամ տեղեկացնել, որ կոմիտեն, գործող օրենսդրական կարգավորումների փոփոխությունների շուրջ պատրաստ է նախաձեռնել քննարկումներ։

Դրանց արդյունքում հնարավոր է նախատեսվեն գործող կարգավորումներից առանձնահատկություններ օտարերկրյա պետություններում ՀՀ ռեզիդենտ ֆիզիկական անձանց ստացած որոշ տեսակի եկամուտների հարկման մասով: Նման քննարկումներ արդեն վարվում են քաղաքականություն մշակող մարմնի հետ։

ՊԵԿ-ը հիշեցնում է, որ Հայաստանի Հանրապետությունում և օտարերկրյա պետություններում հարկվող` եկամուտ ստացած ՀՀ ռեզիդենտ ֆիզիկական անձինք, այսինքն այն քաղաքացիները, որոնք հարկային տարվա ընթացքում 183 օր և ավելի փաստացի գտնվել են Հայաստանի Հանրապետությունում և (կամ) որոնց կենսական շահերի կենտրոնը գտնվում է Հայաստանում, ՀՀ օրենսդրության համաձայն, պարտավոր են հաշվարկել և վճարել եկամտային հարկ` սահմանված դրույքաչափերով (օրինակ, 2023 թվականի համար եկամտային հարկը կազմում է 20 %):

Ստացված եկամուտներից հաշվարկված եկամտային հարկի գումարները նվազեցվում են ֆիզիկական անձանց կողմից օտարերկրյա պետություններում վճարված հարկի գումարի չափով, ինչը չպետք է գերազանցի Հայաստանի Հանրապետությունում հաշվարկվող եկամտային հարկի գումարները: Այսինքն, եթե ՀՀ ռեզիդենտ քաղաքացին աշխատել է այլ պետությունում, ապա նա ունի օտարերկրյա պետությունում վճարված և ՀՀ-ում գործող եկամտային հարկի դրույքաչափի տարբերության չափով եկամտային հարկի վճարման պարտավորություն:

Իսկ, եթե օտարերկրյա պետությունում վճարված եկամտային հարկի դրույքաչափը գերազանցում է ՀՀ-ում գործող եկամտային հարկի դրույքաչափը, ապա այս դեպքում՝ քաղաքացու համար Հայաստանի Հանրապետությունում վճարման որևէ պարտավորություն չի առաջանում:
