Դատախազությունը կոռուպցիոն հանցագործությունների վերաբերյալ քրեական վարույթներով որդեգրել է պատժողական խիստ քաղաքականություն:  ՀՀ դատախազության 106-ամյակի և դատախազության աշխատակցի օրվան նվիրված հանդիսավոր նիստին այս մասին ասել է Գլխավոր դատախազ Աննա Վարդապետյանը՝ խոսելով կոռուպցիայի դեմ պայքարի մասին։

Ըստ գլխավոր դատախազի՝ այս համատեքստում կոռուպցիոն հանցագործություններով գործուն զղջալու հիմքով անձին քրեական պատասխանատվությունից ազատելու մասին որոշում կայացվում է բացառապես այն դեպքերում, երբ առաջին անգամ հանցանք կատարած անձը զղջացել է իր կողմից կատարված հանցանքի համար, համագործակցել է վարույթն իրականացնող մարմնի հետ և հատուցել է հանցանքի արդյունքում պետությանը կամ համայնքին անմիջականորեն պատճառված վնասը:

«Այս մոտեցումն ունի դատարանների ծանրաբեռնվածությունը թոթափելու և  հանցանք կատարած անձանց հետագա իրավահպատակ վարքագիծը խթանելու տրամաբանություն:

Հանցանք կատարած անձի նկատմամբ գործուն զղջալու հիմքով քրեական պատասխանատվությունից ազատելու մասին միջնորդությունը, որպես կանոն, մերժվում է, եթե հանցանք կատարած անձը զբաղեցրել է զինվորական պաշտոն կամ երբևէ կատարել է կոռուպցիոն հանցանք կամ բարձր լատենտայնություն ունեցող այնպիսի հանցանք, ինչպիսիք են՝ կաշառք-ընտրակաշառք ստանալը, փողերի լվացումը և այլն:

Դատախազությունը հետևողական է, որ կոռուպցիոն հանցանք կատարած անձին քրեական պատասխանատվության, պատժի կամ քրեաիրավական ներգործության այլ միջոցների ենթարկելը լինի արդարացի»,-նշել է Վարդապետյանը։

Այս համատեքստում Գլխավոր դատախազը հարկ է համարել ընդգծել, որ Դատախազությունը հետևողականություն է ցուցաբերում, որպեսզի կոռուպցիոն հանցագործությունների վերաբերյալ գործերով մեղավոր ճանաչված անձանց նկատմամբ կիրառվի որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելու պատժատեսակը:

«Կոռուպցիոն հանցագործությունների քննության ընթացքում դատախազների ուշադրության կենտրոնում է նաև հանցանքի կատարմանը նպաստող հանգամանքների վերհանումը և դրանց հետևանքների վերացման ուղղությամբ իրավասու մարմիններին միջնորդագրերի հասցեագրումը։ Այդ նպատակով հսկող դատախազների կողմից տարբեր գերատեսչություններ են հասցեագրվում միջնորդագրեր, որոնց հիման վրա վերանայվում են գործող վերահսկողական լիազորությունների շրջանակը և ներդրվում են նոր իրավական կարգավորումներ, ինչպես նաև կարգապահական պատասխանատվության են ենթարկվում այն հանրային ծառայողները, որոնք թերացել են իրենց ծառայողական պարտականությունների կատարման մեջ»,-եզրափակել է Վարդապետյանը։
