ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում քննվող քրեական գործով իրականացված լրիվ, օբյեկտիվ և բազմակողմանի նախաքննությամբ պարզվել է, որ Երևան քաղաքի Աջափնյակ վարչական շրջանի նախկին ղեկավարը, 2018թ. նոյեմբերից մինչև 2020թ. փետրվար ամիսը զբաղեցնելով նշված պաշտոնը, հանդիսանալով տեղական ինքնակառավարման մարմնում կազմակերպական-տնօրինչական և վարչատնտեսական գործառույթներ իրականացնող անձ, առերևույթ չարաշահել է պաշտոնեական լիազորությունները:

Քննությամբ ձեռք բերված տվյալների համաձայն՝ նշված վարչական շրջանի նախկին ղեկավարը, իր պաշտոնեական դիրքն օգտագործելով ծառայության շահերին հակառակ և անձնական այլ շահագրգռվածությունից ելնելով, վարչական իրավախախտման վերաբերյալ արձանագրությունը, որը կազմվել էր նույն վարչական շրջանի աշխատակազմի քաղաքաշինության և հողօգտագործման բաժնի աշխատակցի կողմից՝ 2019թ. սեպտեմբերի 26-ին Երևան քաղաքի Նազարբեկյան փողոցում առանց համապատասխան շինթույլտվության կառուցվող շինություններ հայտնաբերելուց հետո և ներկայացվել իրեն,  չի ուղարկել Երևանի քաղաքապետարան: Նա արգելել է կազմել համապատասխան արձանագրություններ նաև Երևան քաղաքի Նազարբեկյան փողոցում իրականացվող ինքնակամ շինությունների վերաբերյալ և. օգտվելով հաստիքի կրճատման արդյունքում հիշյալ աշխատակցի կողմից 2019թ. հոկտեմբերի 2-ին աշխատանքից ազատվելու հանգամանքից՝ իր հանցավոր մտադրությունը քողարկելու նպատակով, Երևանի քաղաքապետարան արձանագրությունը չուղարկելու հանգամանքը մեկնաբանել է որպես աշխատակցի կողմից թույլ տրված անփութության արդյունքում իրեն հանձնված չլինելու հետևանք:

Իսկ վերջինիս կողմից վարչական իրավախախտման վերաբերյալ ակտը կազմելուց շուրջ երկու ամիս անց` 2019թ. դեկտեմբերին, փորձել է սկսել վաղեմության ժամկետը լրանալու պատճառաբանությամբ կազմված ակտի խոտանման գործընթացը, ինչի արդյունքում ապօրինի կառուցապատում իրականացնող անձը չի ենթարկվել վարչական պատասխանատվության և համայնքի օրինական շահերին պատճառվել է էական վնաս: 

Նախաքննության ընթացքում Երևան քաղաքի Աջափնյակ վարչական շրջանի նախկին ղեկավարի նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն` չհեռանալու մասին:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
