ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության կիբեռհանցագործությունների և բարձր տեխնոլոգիաների ոլորտում կատարված հանցագործությունների քննության  վարչությունում իրականացված քննչական և այլ դատավարական գործողությունների արդյունքում պարզվել են՝ չորս անձանց կողմից համակարգչային տեխնիկայի օգտագործմամբ առանձնապես խոշոր չափերով՝ ավելի քան 28մլն ՀՀ դրամ առերևույթ հափշտակություն կատարելու դեպքի մի շարք հանգամանքներ:

Նախաքննությամբ պարզվել է, որ չորս անձինք, հանդիսանալով նույն բանկի հաճախորդներ և քարտապաններ, համակարգչային տեխնիկայի օգտագործմամբ ուրիշի գույքի առանձնապես խոշոր չափերով հափշտակություն կատարելու դիտավորությամբ, 2019թ. հոկտեմբերին օնլայն համակարգով իրենց  ընթացիկ հաշվեհամարներից առցանց տարբերակով գումարներ են փոխանցել իրենց քարտային հաշվեհամարներին, որից հետո գումարները փոխանցել են մեկ այլ բանկի հաշվեհամարներին: Այնուհետև սխալ գաղտնաբառ մուտքագրելու միջոցով արգելափակել են քարտերը և, օգտվելով քարտի պրոցեսինգային կենտրոնի աշխատանքի ֆունկցիոնալ յուրահատկությունից, իրենց ընթացիկ հաշվեհամարներից կանխիկացրել և հափշտակել են հաշվում արդեն իսկ ֆիզիկապես գոյություն չունեցող գումարները, իսկ նրանցից մեկը՝ կանխիկացնելու փորձ է կատարել:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ որոշումներ են կայացվել նրանցից երեքին՝ ՀՀ քրեական օրենսգրքի 181-րդ հոդվածի (հափշտակություն, որը կատարվել է համակարգչային տեխնիկայի օգտագործմամբ) 3-րդ մասի 1-ին կետով, իսկ մյուսին՝ 34-181-րդ հոդվածի (հափշտակության փորձ, որը կատարվել է համակարգչային տեխնիկայի օգտագործմամբ)  3-րդ մասի 1-ին կետով որպես մեղադրյալ ներգրավելու մասին: Նրանցից  երեքի  նկատմամբ հայտարարվել է հետախուզում և որպես խափանման միջոց ընտրվել կալանավորումը:

Միջոցներ են ձեռնարկվում՝ դեպքի հանգամանքների օբյեկտիվ, լրիվ և բազմակողմանի քննությունն ապահովելու, կատարված հափշտակությանը մասնակցություն ունեցած հնարավոր հանցակիցներին ու առնչություն ունեցող անձանց պարզելու և հայտնաբերելու ուղղությամբ։

Նախաքննությունը  շարունակվում է:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
