Մամուլում տարածվել է հաղորդագրություն այն մասին, որ «Գագիկ Խաչատրյանին զրկել են առողջության պահպանման սահմանադրական իրավունքից»։

Արդարադատության նախարարությունը հարկ է համարում օբյեկտիվ իրականությունը չխեղաթյուրելու համար կրկին ներկայացնել պարզաբանում հաղորդագրությամբ ներկայացված տեղեկության վերաբերյալ. 

Արդարադատության նախարարությունը երեկ տարածած հաղորդագրությամբ նշել է, որ կալանավորված անձ Գագիկ Խաչատրյանը «Աստղիկ» բժշկական կենտրոնից դուրս է գրվել կենտրոնի որոշմամբ: Դուրսգրման բնօրինակ փաստաթուղթի լուսապատճենը կցվել է հանցագործության մասին հաղորդմանը և ներկայացվել ՀՀ գլխավոր դատախազություն:

Ի գիտություն փաստաբանական խմբին՝

1) Քաղաքացիական բժշկական հաստատությունում գտնվող հիվանդի դուրսգրումը չի կարող իրականացվել այլ հաստատության, այս դեպքում՝ «Քրեակատարողական բժշկության կենտրոն» ՊՈԱԿ-ի տնօրենի որոշմամբ: Դուրսգրումն իրականացնում է կոնկրետ այն բժշկական կենտրոնի որոշմամբ, որտեղ հիվանդը գտնվում է: Դուրսգրման էպիկրիզում «Աստղիկ» բժշկական կենտրոնը ևս նշել է, որ դուրսգրումն իրականացվել է՝ հաշվի առնելով ՊՈԱԿ-ի տնօրենի N Ե-863 նամակը համարժեք բուժման մասին և կոնսիլիումի արդյունքները: Այս պայմաններում առնվազն անհասկանալի է, թե փաստաբանական խումբը դուրսգրման գործընթացի իրավաչափության ինչն է վիճարկում: 

ՊՈԱԿ-ը հայտնել է իր պատրաստակամությունը քրեակատարողական հիմնարկների պայմաններում երաշխավորել կալանավորված անձ Գագիկ Խաչատրյանի՝ առողջության պահպանման սահմանադրական իրավունքը, ուստի, փաստաբանական խմբին առաջարկում ենք առավել մանրամասն ծանոթանալ դուրսգրման էպիկրիզին և իրականությանը չհամապատասխանող տեղեկություններ տարածելու փոխարեն կենտրոնանալ իրենց պարտականությունների վրա և երաշխավորել կալանավորված անձ Գագիկ Խաչատրյանի պաշտպանության իրավունքը (Հիշեցնում ենք, որ ՊՈԱԿ-ի տնօրենը «Աստղիկ» բժշկական կենտրոնին ուղղված գրությամբ բժշկական կենտրոնի ուշադրությունն է հրավիրել այն հանգամանքի վրա, որ պատրաստ է ապահովել կալանավորված անձ Գագիկ Խաչատրյանի բժշկական օգնությունն ու սպասարկումը, այդ թվում՝ ապահովել նրան ցուցված բուժումը հրավիրված մասնագետի միջոցով՝ հաշվի առնելով այն, որ փաստացի «Աստղիկ» բժշկական կենտրոնում կալանավորված անձ Գագիկ Խաչատրյանը որպես այդպիսին ստացիոնար բուժում չի ստանում):

2) Քաղաքացիական բժշկական հաստատությունում գտնվող հիվանդի դուրսգրման համար լավացման փաստը պարտադիր չէ:

Վերահաստատում ենք Արդարադատության նախարարության դիրքորոշումն առ այն, որ Նախարարությունը երաշխավորում է ազատությունից զրկված յուրաքանչյուր անձի, այդ թվում՝ կալանավորված անձ Գագիկ Խաչատրյանի առողջության պահպանման իրավունքը:
