ԱԺ փոխխոսնակ Ալեն Սիմոնյանի առաջարկած նոր օրենսդրական նախաձեռնությամբ նախատեսվում է սոցիալական ցանցերում եւ լրատվամիջոցներում հրապարակված վիրավորանքի եւ զրպարտության համար փոխհատուցման չափը հնգապատկել. վիրավորանքի դեպքում 1 միլիոն դրամից դարձնել 5 միլիոն դրամ, զրպարտության դեպքում` 2 միլիոնից 10 միլիոն դրամ: Խոսքը Քաղաքացիական օրենսգրքի 1087.1 հոդվածում` պատվին, արժանապատվությանը կամ գործարար համբավին հասցված վնասի փոխհատուցման կարգում փոփոխություններ կատարելու մասին է: Նշվում է, որ վիրավորանքի դեպքում անձը կարող է դատական կարգով պահանջել հետեւյալ միջոցներից մեկը կամ մի քանիսը.

  • Հրապարակայնորեն ներողություն խնդրել:
  • Եթե վիրավորանքը տեղ է գտել լրատվական գործունեություն իրականացնողի տարածած տեղեկատվության մեջ, ապա լրատվության այդ միջոցով լրիվ կամ մասնակի հրապարակել դատարանի վճիռը:
  • Սահմանված նվազագույն աշխատավարձի մինչեւ 1000-ապատիկի չափով փոխհատուցում վճարել:

Զրպարտության դեպքում անձը կարող է դատական կարգով պահանջել հետեւյալ միջոցներից մեկը կամ մի քանիսը.

  • Եթե զրպարտությունը տեղ է գտել լրատվական գործունեություն իրականացնողի տարածած տեղեկատվության մեջ, ապա լրատվության այդ միջոցով հրապարակայնորեն հերքել զրպարտություն համարվող փաստացի տվյալները եւ (կամ) հրապարակել դրանց վերաբերյալ իր պատասխանը:
  • Սահմանված նվազագույն աշխատավարձի մինչեւ 2000-ապատիկի չափով փոխհատուցում վճարել:

«Նման կարգավորումը միտված է պաշտպանելու անձի պատիվն ու արժանապատվությունը, կեղծ զրպարտչական եւ (կամ) վիրավորական արտահայտություններից: Խոսքի արտահայտությունն ընդունելով որպես բարձրագույն արժեք ժողովրդավարական հասարակությունում, այնուամենայնիվ, անհրաժեշտ է փաստել, որ այն բացարձակ իրավունք չէ, եւ կարող է սահմանափակվել այլոց իրավունքների պաշտպանության նպատակով»,-ասված է նախագծում:
