Գլխավոր դատախազի խորհրդական Գոռ Աբրահամյանը Ֆեյսբուքի իր էջում գրել է․

«Քանի որ հանրային հետաքրքրությունը մեծ է, և բազմաթիվ հարցեր եմ ստանում լրագրողներից, ուզում եմ տեղեկացնել, որ ստացել ենք Գագիկ Ծառուկյանի նկատմամբ կալանքը որպես խափանամն միջոց ընտրելու վերաբերյալ ԱԱԾ քննչական դեպարտամենտի ներկայացրած միջնորդության մասին Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանի որոշումը և ուսումնասիրել։

Ըստ այդմ՝ նախ՝ ուզում եմ նշել, որ միջնորդության մերժումը պայմանավորված չէ հիմնավոր կասկածի հետ, այսինքն դատարանը համարել է, որ հիմնավոր կասկածն առկա է, այլ վերաբերում է կալանքը որպես խափանման միջոց ընտրելու հիմքերին, մասնավորապես՝ քրեական դատավարությանը մասնակցող անձանց վրա անօրինական ազդեցություն գործադրելու, գործի համար նշանակություն ունեցող նյութերը թաքցնելու կամ կեղծելու, քրեական վարույթն իրականացնող մարմնի կանչով առանց հարգելի պատճառների չներկայանալու կամ այլ ճանապարհով գործի քննությանը խոչընդոտելու հիմքին։

Դատախազության գնահատմամբ դատարանն անտեսել է և պատշաճ չի գնահատել խափանման միջոց կալանքի ընտրության հիմքերին վերաբերող՝ միջնորդությամբ ներկայացված հիմնավորումները, այն ռիսկերը, որոնք պայմանավորված են եղել ազատության մեջ գտնվելու դեպքում նախաքննության ընթացքում նրա փաստացի ղեկավարման ներքո գտնվող կուսակցական կառույցներում, նրանից ֆինանսական և անձնական այլ կախվածություն ունեցող անձանցից վերաբերելի փաստաթղթեր ձեռք բերելու անհրաժեշտության, ենթադրյալ հանցագործության կատարմանը ներգրավված աձանց հնարավոր բազմաթիվության, ենթադրյալ հանցագործությունների լայն աշխարհագրության պայմաններում իր կապերի և ֆինանսական ռեսուրսների, հանցագործության կատարմանը ենթադրաբար ներգրավված անձանց նկատմամբ ունեցած հեղինակությունն ու ազդեցությունը գործադրելու, նրանց նկատմամբ անօրինական ներգործություն ունենալու, գործի համար նշանակություն ունեցող նյութեր թաքցնելու միջոցով քննության ընթացքին խոչընդոտելու դատարանին ներկայացված իրական ռիսկերը:

Հետևաբար, քանի որ դատարանի կողմից կայացվել է անհիմն և ապօրինի դատական ակտ, ՀՀ դատախազությունն այն անպայման բողոքարկելու է ՀՀ վերաքննիչ քրեական դատարան»։
