ՍԴ դատավորները չեն կարող փոխվել, քանի դեռ «Սահմանադրական դատարանի մասին» ՀՀ Սահմանադրական օրենքի 88-րդ հոդվածը չի փոխվել: Այս մասին Ֆեյսբուքի իր էջում գրում է ԱԺ նախկին փոխնախագահ Արփինե Հովհաննիսյանը:

Նա, մասնավորապես, գրել է.

«Ռ. Բադասյանը ընդունել է, որ իրենք անփույթ են աշխատել, երբ չեն փոխել «Սահմանադրական դատարանի մասին» ՀՀ սահմանադրական օրենքը, բայց այդ անփութությունը շատ բարձր գին ունի ու զրկում է նրանց այս պահին, Սահմանադրական դատարանի հանդեպ որևէ գործողություն կատարելու հնարավորությունից: Բացատրեմ ինչու:

Նա ճիշտ է, երբ ասում է, որ ՍԱՀՄԱՆԱԴՐՈՒԹՅՈՒՆԸ բարձրագույն իրավաբանական ուժ ունի, բայց սխալվում է մի կարևոր հարցում:

2005 թվականի Սահմանադրությունն էր, որ ընդհանուր հիմունքների 6-րդ հոդվածում խոսում էր Սահմանադրության ԱՆՄԻՋԱԿԱՆ գործողության մասին:

2015թ. Սահմանադրության մեջ ԳՐՎԱԾ ՉԷ, որ այն ունի անմիջական գործողություն: Այդ կետը հանված է: Միայն 3-րդ հոդվածի 3-րդ մասն է խոսում այն մասին, որ « Հանրային իշխանությունը սահմանափակված է մարդու և քաղաքացու հիմնական իրավունքներով և ազատություններով՝ որպես անմիջականորեն գործող իրավունք:»

Այսինքն` բացի այս դեպքից մնացած բոլոր դեպքերում, Սահմանադրությունը անմիջական ուժ ՉՈՒՆԻ ու պետք է կոնկրետացվի օրենքներում: Իսկ այս դեպքում` «Սահմանադրական դատարանի մասին» ՀՀ ՍԱՀՄԱՆԱԴՐԱԿԱՆ օրենքում գրված է, որ այդ դատավորները պաշտոնավարում են:
Սա է հետևանքը, երբ ձեր սահմանադրական փոփոխությունները զեկուցում է ոչ իրավաբանը ու մի խելքը գլխին իրավաբան ձեզ տարրական բաներ մատնացույց ՉԻ անում: Գիտեմ, որ թքած ունեք Սահմանադրության ու օրենքների վրա, բայց տեղեկացնեմ, որ իրավաբանությունը լուրջ դեմքով լեզվին տալու նուրբ արվեստ ու արհեստ չէ, հետևաբար ձեր հանցանքների շարքին ևս մեկը ավելացնելու կոնկրետ դեպք եմ նշում:
Այս պահին այդ օրենքում այլ կարգավորում կա ու դուք պարտավոր եք այդ կարգավորումը հարգել»:
