Այսօր տեղեկացա, որ քաղաքական իշխանությունը պատրաստվում է հաջորդ հանցագործությանը: Այս մասին իր ֆեյսբուքյան էջում գրել է իրավապաշտպան, «Հայրենիք» կուսակացության  անդամ Արսեն Բաբայանը:

«Այսօր տեղեկացա, որ քաղաքական իշխանությունը պատրաստվում է հաջորդ հանցագործությանը:

Մասնավորապես պլանավորում են հիմք ընդունել նախագահի տեղեկացումն այն մասին, թե վերջինս չի ստորագրելու ՍԴ մասին օրենքը և վաղը պետք է հրապարակեն այդ օրենքը` դրանք փորձելով մտցնել ուժի մեջ:

Փորձելով օգնել իշխանությանը խորհուրդ եմ տալիս չանել նոր խախտում: Իսկ դա կրկին կոպտագույն հակասահմանադրական քայլ կլինի, քանի որ.

Սահմանադրության 129-րդ հոդվածով սահմանված է, որ օրենքները ստորագրելու համար Հանրապետության նախագահն ունի 21 օր ժամանակ: Ուշադրության է արժանի այն հանգամանքը, որ սահմանադրությամբ նախատեսված այդ ժամկետը նախագահին տրված է օրենքներն ստորագրելու համար, և ոչ թե չստորագրելու:

Հետևաբար որևէ մեկն իրավունք չունի նախագահին տրված ժամկետի ավարտից շուտ իրականացնել որևէ գործողություն:

Ինչ վերաբերվում է նախագահի կողմից ԱԺ նախագահին չստորագրելու մասին տեղեկացման հանգամանքին, ապա այդպիսի լիազությամբ կամ գործառույթով օժտված չէ նախագահը, ուստի այդ տեղկացումը չունի իրավական հենք և չի կարող դառնալ որևէ գործողության իրավական հիմք:

Չէ, ես իհարկե գիտեմ, որ դուք ինչ ուզում անում եք, գիտեմ, որ Հայաստանում դուք իրավական բանդիտիզմ եք իրականացնում, բայց մտքովս անցավ նորից հուշել, որ չլսեք ձեր հայտնի սահմանադրագետին»:

Ավելի վաղ հայտնել էինք, որ Հանրապետության նախագահ Արմեն Սարգսյանն այսօր Ազգային ժողովի նախագահ Արարատ Միրզոյանին տեղեկացրել է, որ «Սահմանադրական դատարանի մասին» սահմանադրական օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին օրենքը հարակից օրենքով իր կողմից չեն ստորագրվելու:
