ՀՊՏՀ ռեկտորի պաշտոնակատար Ռուբեն Հայրապետյանը ֆեյսբուքյան էջում գրառում է արել՝ տեղեկացնելով, որ Կրթության մասին օրենքն արգելում է դեկտեմբերի 1-ից հետո քննությունների ցանկ փոխել, մինչդեռ երբ մարտին հանրապետությունում հայտարարվեց արտակարգ դրություն, ԿԳՄՍՆ-ն որոշեց փոխել բուհերի ընդունելության կարգը և քննությունների ցանկը:

«ԿԳՄՍՆ-ի հերթական «գլուխգործոցը». ընդունելության քննությունների արդյունքներն անվավեր են:

Ի՞նչ է լինում, երբ կրթության ոլորտի պատասխանատուները ոլորտի զարգացման փոխարեն կոնկրետ անձանց շահերն սպասարկող ապօրինություններով են զբաղված:

Եվ այսպես, երբ մարտ ամսին հանրապետությունում հայտարարվեց արտակարգ դրություն, ԿԳՄՍՆ-ն որոշեց փոխել բուհերի ընդունելության կարգը և քննությունների ցանկը: Սակայն, քանի որ ԿԳՄՍՆ-ի բարձրաստիճան պաշտոնյաներն ամիսներ շարունակ հովանավորչությամբ էին ծանրաբեռնված, բնականաբար, պիտի «մոռանային», որ Կրթության մասին օրենքն արգելում է դեկտեմբերի 1-ից հետո քննությունների ցանկ փոխել:

«5. Բարձրագույն ուսումնական հաստատությունների տվյալ տարվա մասնագիտությունների և ընդունելության քննությունների ցանկը կրթության պետական կառավարման լիազորված մարմնի ներկայացմամբ հաստատում և մինչև տվյալ տարվա ԴԵԿՏԵՄԲԵՐԻ 1-ը պաշտոնապես հրապարակում է ՀՀ կառավարությունը: ՀԱՍՏԱՏՎԱԾ ՑԱՆԿՈՒՄ ՓՈՓՈԽՈՒԹՅՈՒՆՆԵՐ ԵՒ ԼՐԱՑՈՒՄՆԵՐ ԿԱՏԱՐԵԼՆ ԱՐԳԵԼՎՈՒՄ Է»:

Անտեսելով օրենքի արգելքը՝ ԿԳՄՍ նախարարությունը Կառավարության հաստատմանն է ներկայացնում 2020-2021 ուսումնական տարվա ընդունելության քննությունների նոր ցանկը և ընդունելության նոր կարգը: Սա նշանակում է, որ Կառավարության տվյալ որոշումն ԱՆՎԱՎԵՐ Է, որովհետև այն հակասել է ավելի բարձր իրավաբանական ուժ ունեցող նորմատիվ իրավական ակտի՝ Կրթության մասին ՀՀ օրենքին: Իսկ քանի որ այն անվավեր է, ապա, ԿԳՄՍՆ-ի հանցավոր անփութության (315) պատճառով, առոչինչ են դառնում անվավեր ցանկով անցակցված ընդունելության քննությունների արդյունքները:

Դրանից միայն մեկ ամիս անց՝ հունիսի 25-ին, երբ արդեն անվավեր ցանկի ու կարգի հիմքով բուհ դիմելու գործընթացն ավարտվել էր, ԿԳՄՍՆ-ն Ազգային ժողովի հաստատմանն է ներկայացնում Կրթության մասին օրենքում լրացում կատարելու մասին օրենքը, որտեղ նշվում է, որ արտակարգ դրության դեպքում ցանկը կարելի է փոխել : Սակայն, դա արդեն ուշացած փոփոխություն էր, որովհետև ԿԳՄՍՆ-ի ներկայացրած նախագծով Կառավարության որոշումն ընդունվել է՝ հակասելով այդ պահին գործող օրենքին:

Հետևաբար՝ ոչ միայն այս օրերին պայքարող բարձր միավորներ ունեցող դիմորդները դուրս չեն մնացել (առաջին հայտի գերակայության նոր կարգն ուժ չունի), այլև ընդունելության քննությունների արդյունքներն առհասարակ անվավեր են:

Ելքը մեկն է՝ միայն այս տարվա համար խնդրին տալ օրենքին չհակասող իրավիճակային լուծում (կան իրական տարբերակներ, բարեբախտաբար, դեռ ուշ չէ), որպեսզի որևէ դիմորդի իրավունք չոտնահարվի, միաժամանակ վերջապես պատասխանատվության ենթարկել կրթության ոլորտի այն բարձրաստիճան պաշտոնյաներին, որոնց հերթական ապօրինության պատճառով բուհերի ընդունելության քննության արդյունքները, փաստացի, անվավեր են դարձել»,-գրել է Ռուբեն Հայրապետյանը:
