Փոփոխություն՝ «Արտակարգ դրություն հայտարարելու մասին» օրենքում

Հայաստանում ազատությունից զրկված անձինք նորից հնարավարություն կունենան ամսվա ընթացքում ունենալ մինչև երեք ժամ տևողությամբ մեկ տեսակցություն, ինչից զրկված էին արտակարգ դրության հաստատումից մինչև այսօր։  Համապատասխան որոշումն ընդունեց Կառավարությունը հուլիսի 23-ի նիստում՝ չզեկուցվող հարցերից մեկով՝ փոփոխություն  կատարելով «Հայաստանի Հանրապետությունում արտակարգ դրություն հայտարարելու մասին»  օրենքում։

Հայաստանում նոր կորոնավիրուսային հիվանդության՝ COVID-19-ի հետևանքով՝ 2020 թվականի մարտի 16-ին արտակարգ իրավիճակի հիմքով հայտարարված արտակարգ դրության ժամանակահատվածում ազատությունից զրկված անձանց շրջանում շուրջ 4 ամիս է, ինչ արգելված են տեսակցությունները հարազատների հետ (բացառությամբ տեսազանգից օգտվելու դեպքերի):

Արդարադատության նախարարության ներկայացրած նախագծում նշված է՝  արտակարգ իրավիճակի հիմքով արտակարգ դրությունն արդեն իսկ 4 ամիս է, ինչ շարունակվում է, և դեռևս հստակ չեն երկրում համաճարակային ներուժի թուլացման հնարավոր հեռանկարները, ուստի անհրաժեշտ է վերականգնել ազատությունից զրկված անձանց տեսակցելու իրավունքը, ինչը կնպաստի ազատությունից զրկված անձանց արտաքին աշխարհի հետ կապի ամրապնդմանը և վերասոցիալականացմանը:

Արդարադատության նախարարությունն այս նախագծի հիմքում դրել է  ազատությունից զրկված անձանց և նրանց մերձավոր ազգականների առաջարկները,  հաշվի են առել այն, որ համավարակի վերացման վեաբերյալ հստակ ժամկետներ չկան։ Նախագծի հիմնավորումներում նշված է նաև, որ հաշվի է առնվել միջազգային կառույցների, մասնավորապես՝  Խոշտանգումների և անմարդկային կամ արժանապատվությունը նվաստացնող վերաբերմունքի կամ պատժի կանխարգելման եվրոպական կոմիտեի (ԽԿԿ)  տեսակետները, որտեղ ընդգծում են, որ կանխարգելիչ միջոցները չպետք է հանգեցնեն ազատությունից զրկված անձանց նկատմամբ անմարդկային կամ նվաստացնող վերաբերմունքի:

Որոշման մեջ ներկայացվել է նաև միջազգային փորձի ուսումնասիրությունը, մասնավորապես՝ Իտալիայի օրինակը, որը  վարակակիրների թվով աշխարհում առաջիններից էր, բայց  քրեակատարողական հիմնարկներում տեսակցություններն արգելվել են միայն այն շրջաններում, որտեղ վարակակիրները մեծ թիվ են կազմել, իսկ մյուս շրջաններում ընդամենը խստացվել են կանոնները:

Բերված է նաև ԱՄՆ-ի և  Իռլանդիայի փորձը, որտեղ  առհասարակ չեն արգելվել ազատությունից զրկված անձանց տեսակցությունները, այլ խիստ չափանիշեր են սահմանվել տեսակցողներին ստուգելու հարցում, իսկ Անգլիայում և Ուելսում քրեակատարողական հիմնարկները շարունակել են գործել նույն ռեժիմով:
