ՀՀ հատուկ քննչական ծառայությունում քննված քրեական գործով ձեռք բերված բավարար ապացույցների համակցությամբ պարզվել է, որ 2020թ. ապրիլի 29-ին՝ ժամը 17:05-ի սահմաններում, ՀՀ Ազգային ժողովի փոխխոսնակ Ալեն Սիմոնյանը, Երևան քաղաքի «Մալիբուի այգի» կոչվող զբոսայգու տարածքում նկատելով «Ադեկվադ» կուսակցության նախագահ Արթուր Դանիելյանին, բարևել է նրան, սակայն վերջինս, ներկա անձանց մոտ սեփական անձի առավելությունն ընդդգծելու նպատակով, սեռական բնույթի հայհոյանք է տվել ԱԺ փոխխոսնակի և նրա ծնողների հասցեին, որից անակնկալի եկած Ա.Սիմոնյանը ճակատով մեկ անգամ հարվածել է Ա. Դանիելյանի քթին, ինչից հետո նրանց միջև քաշքշուկ է սկսվել: Այդ ժամանակ Ա. Դանիելյանը, անտեսելով հասարակական վայր հանդիսացող Երևանի մարդաշատ զբոսայգում գտնվելու հանգամանքը, տարածքում իրենց հանգիստն անցկացնող մարդկանց ներկայությամբ, խուլիգանական դրդումներով, շարունակել է դիտավորությամբ կոպիտ կերպով խախտել հասարակական կարգը՝ հասարակության նկատմամբ դրսևորելով անթաքույց արհամարհանք և բացահայտ անհարգալից վերաբերմունք, սեռական բնույթի հայհոյանքներ է տվել ՀՀ օրենսդիր իշխանության մարմնի ղեկավար աշխատողի հասցեին և բռնություն գործադրել նրա նկատմամբ՝ բռունցքով հարվածներ է հասցրել Ա.Սիմոնյանի գլխի շրջանին և մարմնի այլ մասերին՝ պատճառելով մարմնական վնասվածքներ:

Ա.Դանիելյանը, անտեսելով իրեն մոտեցած քաղաքացիների` կռիվը դադարեցնելու վերաբերյալ հորդորները, շարունակել է խուլիգանական գործողությունները, որի ընթացքում հարվածներ է հասցրել ԱԺ փոխխոսնակին, ապա հետապնդել արդեն իսկ հեռացող Ա. Սիմոնյանին և նրա հասցեին տվել սեռական բնույթի հայհոյանքներ:

Վերը նշված հանցավոր արարքի կատարման համար Արթուր Դանիելյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 258-րդ հոդվածի 2-րդ մասով:

Նախաքննության ընթացքում պարզվել է, որ Ա.Դանիելյանին հարված հասցնելու պահին Ա. Սիմոնյանը գտնվել է հոգեկան խիստ հուզմունքի վիճակում, որպիսի հանգամանքը հաստատվել է քրեական գործով ձեռք բերված փաստական տվյալներով: Նման պայմաններում 2020թ. հուլիսի 30-ին որոշում է կայացվել Ա.Սիմոնյանի նկատմամբ քրեական հետապնդում չիրականացնելու մասին՝ նրա արարքում հանցակազմի բացակայության հիմքով:

Վարույթն իրականացնող մարմինը, ձեռք բերված ապացույցները բավարար համարելով քրեական գործով մեղադրական եզրակացություն կազմելու և գործը դատարան ուղարկելու համար, այդ մասին հայտնել է տուժողին և նրա ներկայացուցչին,  մեղադրյալին ու նրա պաշտպանին՝ նրանց տրամադրելով քրեական գործի նյութերը ծանոթանալու համար:
