Սահմանադրական դատարանի և Վճռաբեկ դատարանի միավորումը պարզապես հակասում է Սահմանադրության անփոփոխելի նորմ սկզբունքներին՝ իրավական պետություն սկզբունքին և իրավունքի գերակայության սկզբունքին, քանի որ դասական իմաստով ՆԱՀԱՆՋ է իրավունքի պաշտպանության ստանդարտի տեսանկյունից։ Այս մասին իր ֆեյսբուքյան էջում գրել է սահմանադրագետ Արամ Վարդեւանյանը:

«Այսօր Պրոֆեսոր Արթուր Ղամբարյանը չափազանց կարևոր և առնվազն սահմանադրական բարեփոխումների հանձնաժողովի անդամների համար սթափեցնող՝ խիստ գնահատական է տվել։ Կիսելով իր կարծիքը ուզում եմ սահմանադրական-պատմական հանգամանք և կարճ իմ կարծիքը ներկայացնել։

Սահմանադրական արդարադատության ամերիկյան մոդելը (վճռաբեկության և սահմանադրական արդարադատության գործառույթները մեկ մարմնում միավորելը) սկիզբ է առել հենց ԱՄՆ-ում ցանկացած սահմանադրագետի համար հասկանալի և հայտնի 1803 թվականի «Մերբերին ընդդեմ Մեդիսոնի» գործով։ ԱՄՆ-ի Գերագույն Դատարանը Ջոն Մարշալի նախագահությամբ առաջին անգամ Կոնգրեսի կողմից ընդունված ակտը ճանաչեց Սահմանադրությանը հակասող և այդ պահից ծնվեց սահմանադրական վերահսկողությունը։

1803 թվականին ԱՄՆ Նախագահն էր լեգենդար Թոմաս Ջեֆերսոնը, իսկ Մերբերիի որպես դատավոր նշանակումը կայացրել էր պաշտոնաթող Նախագահ Ադամսը, իր պաշտոնավարման ավարտից օրեր առաջ։ Մեդիսոնը հավատարիմ լինելով Ջեֆերսոնի մոտեցումներին չէր ապահովում Մերեբերիի նշանակումը։ ԱՄՆ Գերագույն դատարանը ՀԱԿԱՌԱԿ գնալով իշխանությանը ճանաչեց վերջիններիս գործողությունների ոչ իրավաչափությունը և խնդրո առարկա իրավական ակտը ճանաչեց Սահմանադրությանը հակասող, ինչը բնականաբար առաջացրեց քաղաքական բավականին սուր քննադատություն։

Ավելին՝ Գերագույն դատարանի դատավոր Մեդիսոնը ըստ որոշ իրավագետների ուներ շահերի բախում, քանի որ անմիջական մասնակցություն էր ունեցել Մերբերիի նշանակման հարցում, որպես պաշտոնատար անձ 1801 թվականին, սակայն դա որևէ կերպ չստվերեց Մեդիսոնի գործողությունների ակնհայտ իրավաչափությունը։ Վստահ եմ շատերը այս ամենը կարդալով անալոգիաներ անցկացրեցին հենց վերջերս տեղի ունեցած մի շարք իրադարձությունների հետ հենց Հայաստանի Սահմանադրական դատարանի նկատմամբ, սակայն էականը, ԱՌԱՆՑՔԱՅԻՆԸ կայանում էր նրանում, որ Սահմանադրական վերահսկողության ամերիկյան մոդելը սկզիբ է առել լրջագույն իրավա-քաղաքական կոնֆլիկտի արդույնքում և երբեք չի խաթարվել։

Գերագույն դատարանի դատավորներին այդ որոշումից հետո՝ վաղ կենսաթոշակի չեն ուղարկել կամ լիազորությունները չեն դադարեցրել։ Հենց այս ամենի համակցությունն է, որ Սահմանադրական արդարադատության ամերիկյան մոդելը՝ վճռաբեկության և սահմանադրական արդարադատության գործառույթները մեկ մարմնում միավորելու պայմաններում, գործում է արդյունավետ՝ դարերով։

Վերադառնանք Հայաստանի փորձին։ Ունենք մի իրավիճակ, որ օրինակ՝ Ազգային ժողովը գիտակցելով, որ Սահմանադրական դատարանը ԵՆԹԱԿԱ, ՍՏՈՐԱԴԱՍ մարմին չէ և ՍԴ որոշումները կայացվում են Սահմանադրության գերակայության պահպանմամբ, նույնիսկ խախտելով Սահմանադրությունը ՉՑԱՆԿԱՑԱՎ ստանալ ՍԴ դիրքորոշումը ենթադրյալ սահմանադրական փոփոխությունների վերաբերյալ։ Ունենք մի իրավիճակ, որ Սահմանադրական դատարանը 1996 թվականից ի վեր հազարավոր մարդկանց իրավունքներ է պաշտպանել և վերականգնել, այդ թվում ՃԻՇՏ ԿԵՐՊ ՀԱԿԱԴՐՎԵԼՈՎ Վճռաբեկ դատարանին և նախապտվությունը տալով իրավունքի գերակայությանը։ Հենց այդ հակադրումների արդյունքում է, որ իրավունքը զարգացել է․․․։ Այս պայմաններում ինչ է առաջարկվում․ վերացնել այդ հազվադեպ սակայն չափազանց կարևոր հակադրումը, վերացնել ՄԱՐԴՈՒ սահմանադրական արդարադատության իրավունքը․․․հանուն չեմ կարող ասել ինչի, սակայն վստահ կարող եմ ասել ՈՉ ԻՐԱՎՈՒՆՔԻ ԳԵՐԱԿԱՅՈՒԹՅԱՆ։

Որպես վերջաբան կասեմ հետևյալը․ Սահմանադրական դատարանի և Վճռաբեկ դատարանի միավորումը պարզապես հակասում է Սահմանադրության անփոփոխելի նորմ սկզբունքներին՝ իրավական պետություն սկզբունքին և իրավունքի գերակայության սկզբունքին, քանի որ դասական իմաստով ՆԱՀԱՆՋ է իրավունքի պաշտպանության ստանդարտի տեսանկյունից»։
