Փաստաբան Տիգրան Աթանեսյանը ֆեյսբուքյան գրառմամբ անդրադարձել է գլխավոր դատախազի օգնական Գոռ Աբրահամյանի այսօրվա գրառմանը Մասիսի քաղաքապետ Դավիթ Համբարձումյանի խափանման միջոցի վերաբերյալ Վճռաբեկ դատարանի որոշմանը: Գրառման մեջ ասվում է.

«Մասիսի քաղաքապետ Դավիթ Համբարձումյանը չի կալանավորվի:

ՀՀ գլխավոր դատախազի խորհրդականը շաբաթ օրով, երևի անգործության պատճառով, ՖԲ-ում գրառում է կատարել Դավիթ Համբարձումյանի խափանման միջոցի վերաբերյալ ՀՀ վճռաբեկ դատարանի 2019 թվականի նոյեմբերին կայացրած և նոր կողմերին ուղարկած մի որոշման մասին:

Նախ՝ որոշմամբ գլխավոր դատախազության բողոքը ՄԵՐԺՎԵԼ Է:

Ինչ վերաբերում է վճռաբեկ դատարանի ուշացած դատողություններին առ այն, թե ստորադաս դատարանների կողմից գրավի կիրառման պահին այն եղել է անթույլատրելի, ապա պետք է ցավով նշել, որ նույն վճռաբեկ դատարանը պետք է փորձեր գոնե նշել, թե գրավի կիրառումը փաստացի ինչպես է անդրադարձել գործի քննության վրա: Այդ դեպքում պարզ կլիներ, որ գործի քննությունը որևէ կերպ չի տուժել, ուստի գրավի անթույլատրելիության մասին դատողությունը խիստ վերացական է և իրականությունից կտրված:

Բավական է նշել, որ աղմուկ հանած զանգվածային անկարգություններ կազմակերպելու մեղադրանքը, որի մասին թմբկահարում էր դատախազությունը, հօդս ցնդեց և այդ մասով Դ.Համբարձումյանի նկատմամբ քրեական հետապնդումը դադարեցվել է քննիչի կողմից՝ արարքում հանցակազմի բացակայության պատճառաբանությամբ: Առկա մեղադրանքը ևս աղերս չունի իրականության հետ, այն ևս փշրվում է դատական քննության ընթացքում և այդ մեղադրանքի միակ իմաստը դա դատախազության «դեմքի փրկությունն էր» 2018 թվականի հունիսին կազմակերպված արշավի դիմաց:

Գլխավոր դատախազի խորհրդականին անկեղծ ընկերական խորհուրդ՝ շաբաթ օրով կեղծ սենսացիաներ չստեղծել և այն անցկացնել ընտանեկան և բարեկամական միջավայրում՝ ստանալով դրական լիցքեր»:
