«Մեկ Հայաստան» կուսակցության համահիմնադիր Արթուր Ղազինյանը ֆեյսբուքյան իր էջում գրառում է կատարել՝ անդրադառնալով ավելի վաղ ՀՔԾ-ի տարածած պարզաբանմանը «Փաստ» օրաթերթի այսօրվա հրապարակման վերաբերյալ։

«Հարգելի Հատուկ քննչական ծառայություն,

Խնդրում եմ լրագրողներին մի մեղադրեք տեղեկատվության տրամադրման ընթացքում թույլ տրված մասնակի շեղման համար:

Ավելի ճիշտ կլինի ձեր քննիչներին սովորեցնեք, որ հանցագործության մասին ներկայացված հաղորդմանը անհասկանալի ծագման գրությամբ չեն պատասխանում, այլ կայացնում են ՀՀ քր. դատ. օրենսգրքի պահանջներին համապատասխան որոշում՝ քրեական գործ հարուցելու, հարուցումը մերժելու կամ ըստ ենթակայության ուղարկելու մասին:

Իսկ պաշտոնեական կեղծիքի հիմքով քրեական գործ հարուցվելու է, որքան էլ որ դուք դիմադրեք և այդ ընթացքում ցուցաբերեք անգործություն կամ կայացնեք անհիմն որոշումներ:

Առողջ եղեք»,- գրել է Ղազինյանը։

Հիշեցնենք, որ ավելի վաղ Հատուկ քննչական ծառայությունը պարզաբանում է տարածել «Փաստ» օրաթերթի այսօրվա հրապարակման վերաբերյալ, որում ասվում էր, որ դատարանը բավարարել է «Մեկ Հայաստան» կուսակցության նախագահ Արթուր Ղազինյանի բողոքը, Նիկոլ Փաշինյանի նկատմամբ քրեական գործ կհարուցվի՝ պաշտոնեական կեղծիք կատարելու համար։ Պարզաբանման մեջ ասվում է․

«Որոշ լրատվամիջոցներ, հավատարիմ մնալով ապատեղեկատվություն տարածելու իրենց գործելաոճին, դարձյալ շարունակում են միտումնավոր ապակողմնորոշել հանրությանը ոչ հավաստի և մանիպուլյացիոն բնույթի հրապարակումներով: Մասնավորապես` «Փաստ» օրաթերթի` «Դատարանը բավարարեց Ղազինյանի բողոքը. Նիկոլ Փաշինյանի նկատմամբ կհարուցվի քրեական գործ` պաշտոնեական կեղծիքով» վերտառությամբ այսօրվա հրապարկման առնչությամբ հարկ ենք համարում հայտնել, որ 2020 թվականի սեպտեմբերի 22-ին դատավոր Տաթևիկ Գրիգորյանի կողմից կայացված դատական ակտը որևէ առնչություն չունի ՀՀ հատուկ քննչական ծառայությունում նախապատրաստված նյութերով կայացված` քրեական գործ հարուցելը մերժելու մասին որոշման դեմ Արթուր Ղազինյանի կողմից ներկայացված բողոքի հետ: Նշված բողոքը քննվում է այլ դատավորի վարույթում: Տաթևիկ Գրիգորյանի վարույթում քննվել է Ա. Ղազինյանի բողոքը իր մեկ այլ հաղորդման հիման վրա նյութեր չնախապատրաստելու վերաբերյալ: Դատարանի կողմից վարույթն իրականացնող մարմնին ընդամենը պարտավորեցվել է նախապատրաստել նյութեր` քրեական գործ հարուցելու հարցը քննարկելու համար: Այսինքն` դատարանի որոշումը վերաբերում է դիմումը քննարկելու ընթացակարգին, և նշված որոշումը Ա. Ղազինյանի հայտարարության կապակցությամբ քրեական գործ հարուցելու հիմք չէ:

Այսպիսով` նման անհարմար իրավիճակներում չհայտնվելու համար վերը նշված լրատվամիջոցին խորհուրդ ենք տալիս տեղեկատվության հավաստիության վերաբերյալ նախապես պարզաբանումներ ստանալ ՀՀ հատուկ քննչական ծառայությունից»:
