Երեկ ՄԻԵԴ-ը կայացրել է որոշում ավելի վաղ Հայաստանի կողմից ներկայացված Ադրբեջանի դեմ միջանկյալ միջոցի կիրառման մասին խնդրանքը բավարարելու վերաբերյալ: Այս մասին, այսօր՝ սեպտեմբերի 30-ին, ճեպազրույցի ժամանակ նշեց Մարդու իրավունքների եվրոպական դատարանում Հայաստանի Հանրապետության ներկայացուցիչ Եղիշե Կիրակոսյանը:

«Իհարկե, հետեւյալ բովանդակությամբ է որոշումը գնացել, որը կարծում եմ՝ ակնկալելի էր նաեւ մեզ համար՝ հաշվի առնելով իրավիճակի սրությունը, լայնամասշտաբ բնույթը: Որոշման մեջ կոչ է արվում թե Ադրբեջանին, թե Հայաստանին՝ զերծ մնալ այնպիսի միջոցների կիրառումից, որոնք կառաջացնեն կոնվենցիայով երաշխավորված քաղաքացիական բնակչության իրավունքների խախտումներ: ՄԻԵԴ-ի որոշման մեջ նաեւ ասված է, որ կողմերը պետք է հնարավորինս շուտ դատարանին տեղեկացնեն  ձեռնարկված միջոցների մասին:

Այն տեքստը, որ ունենք ՄԻԵԴ-ի որոշման մեջ ակնկալելի էր, որովհետեւ նախ նման նախադեպ, որ պետության դիմումի հիման վրա դատարանը կայացնում է միջանկյալ միջոց, եզակի դեպքեր են: Սա կարելի է ասել թվով երրորդն է: Առաջինը Ուկրաինայի դիմումի հիման վրա կայացված որոշումներն են: Բոլոր դեպքերում դատարանն անդրադառնում է երկու կողմերին էլ: Այդ տեսանկյունից սա մեր հաջողությունն է, որովհետեւ ՀՀ կողմից ներկայացված դիմումի, նաեւ մեր կողմից ներկայացված ապացույցների  հիման վրա է որոշումը կայացվել: Երրորդ, Դատարանը նույնիսկ հարկ չի համարել ուղարկել Ադրբեջանի կառավարությանը՝ լրացուցիչ մեկնաբանություն կամ տեղեկատվություն ստանալու համար, որը սովորաբար անում է»,-ասաց ՄԻԵԴ-ում ՀՀ ներկայացուցիչը:

Անդրադառնալով Հայաստանի հետագա քայլերին, Կիրակոսյանն ասաց. «Հայաստանը 1-2 օրվա ընթացքում կներկայացնի մեր կողմից ձեռնարկած  միջոցառումների մասին, որը վստահ եմ, ավելի քան բավարար կլինի: Կսպասենք նաեւ Ադրբեջանի կողմից ներկայացվածին: Դրա հիման վրա էլ կներկայացնենք մեկնաբանություններ եւ դիրքորոշումներ:

Կարեւոր արձանագրում է, որ այստեղ ճիշտ է նշված են երկու պետությունները, այստեղ բեռը ավելի շատ ընկնում է Ադրբեջանի կառավարության վրա:

Պետությունը միջանկյալ միջոցի համար դիմելիս հայտնում է նաեւ որոշակի մտադրության մասին, որ ցանկանում է բերել միջպետական գանգատ, սակայն դա այս պահին դեռ քննարկման փուլում է: Այս պահին կան սցենարներ, որ քննարկում ենք: Բացի գանգատ ներկայացնելը նաեւ այլ ասիմետրիկ տարբերակներ ենք քննարկում»:

 Կիրակոսյանը նշեց, որ մեր դիմումի մեջ ներառվել են նաեւ Վարդենիսի դեպքերը:

Դիտարկմանը, որ ՄԻԵԴ-ի որոշումից հետո Ադրբեջանը ԱԹՍ-ներով թիրախավորել է Ստեփանակերտը, Կիրակոսյանն ասաց. «Եթե կողմը չի պահպանում որոշման պայմանները, դա համարվում է կոնվենցիայի խախտում: Դատարանը դրան պետք է անդրադառնա իր վճռով: Դա բավականին լուրջ խախտում է, շատ հետեւանքներ կան»:
