ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում իրականացված մեծածավալ քննչական և դատավարական այլ գործողությունների արդյունքում պարզվել են Քաջարանի բնակչին առևանգելու դեպքի մի շարք հանգամանքներ:

Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ Քաջարանի բնակչի և ընկերոջ միջև տեղի ունեցած վեճի հանգամանքները պարզաբանելու համար, Քաջարան համայնքի ղեկավարի կանչով, 2020թ. ապրիլի 26-ին՝ ժամը 20:00-ի սահմաններում, Քաջարանի Լեռնագործների փողոցում գտնվող, վերջինիս պատկանող բենզալցակայանի հետնամասում գտնվող չգործող նախկին ռեստորանի շինությունում հավաքվել են համայնքի ղեկավարը և շուրջ 20 հոգի, որտեղ տեղի է ունեցել ծեծկռտուք, որի ընթացքում Քաջարանի 30-ամյա բնակիչը բռունցքով պատասխան հարված է հասցրել համայնքի ղեկավարի հորը:

Հավաքված բազմության ներկայությամբ հորը հարվածելու համար 30-ամյա տղամարդուն ցուցադրաբար պատժելու և իր հեղինակությունը վերա­հաստատելու նպատակով Քաջարան համայնքի ղեկավարը, նախնական համաձայնության գալով մի խումբ անձանց հետ, 2020թ. ապրիլի 29-ին՝ ժամը 13:00-ի սահմաններում, Քաջարանի Լեռնագործներ փողոցի 18-րդ հասցեում գործող ավտոկայանատեղիում բռնություն գործադրելով՝ ոլորելով 30-ամյա տղամարդու ձեռքերը և բռնելով ոտքերից, նրա կամքին հակառակ մտցրել են նույն համայնքի մեկ այլ բնակչի կողմից վարած ավտոմեքենան, բացահայտ առևանգել են նրան ու դուրս հանելով բնական միկրոսոցիալական միջավայրից՝ տեղափոխել «Աժդանակ» ՍՊ ընկերության տարածք, որտեղ համայնքի ղեկավարը հրացանով կրակել է 30-ամյա տղամարդու ոտքերին, ծեծել նրան: Այնուհետև «Տոյոտա-Պրադո» մակնիշի ավտոմեքենայով վերջինիս տեղափոխել են Ագարակ բնակավայրում գտնվող առանձնատուն, որտեղ կրկին ծեծել են նրան:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ Քաջարան համայնքի ղեկավարին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 131-րդ հոդվածի (Մարդուն  առևանգելը) 2-րդ մասի 1-ին կետով: Միջնորդություն է ներկայացվել դատարան՝ նրա նկատմամբ կալանավորումը որպես խափանման միջոց ընտրելու մասին:

Հիշեցնենք, որ նշված քրեական գործի շրջանակներում մեղադրանք է առաջադրվել ևս 5 անձի:
