«Գլխավոր շտաբի պետը շարունակելու է պաշտոնավարել

(Ի հավելումն նախորդ գրառմանս)

Սահմանադրության 155-րդ հոդվածի 3-րդ մասը սահմանում է, որ զինված ուժերի զինվորական ԱՄԵՆԱԲԱՐՁՐ պաշտոնատար անձը գլխավոր շտաբի պետն է, որին վարչապետի առաջարկությամբ ՆՇԱՆԱԿՈՒՄ է Հանրապետության նախագահը՝ օրենքով սահմանված ժամկետով:

-Այսինքն՝ գլխավոր շտաբի պետին ԱԶԱՏԵԼՈւ լիազորությունը Սահմանադրությամբ սահմանափակված է՝ քաղաքական ուժերի հարաբերակցության պարագայում զինված ուժերին անձեռնմխելի պահելու նպատակով

(Ազատման հիմքերն ընդհանուր են՝ քաղաքացիության կորուստ, օրինական ուժի մեջ մտած մեղադրական դատավճիռ, հրաժարականի դիմում ե այլն):

Սահմանադրության 139-րդ հոդվածը սահմանում է զինված ուժերի և այլ զորքերի բարձրագույն հրամանատարական կազմին նշանակելու եւ ազատելու դեպքերը եւ կարգը, որոնցում Գլխավոր շտաբի պետին ազատելու լիազորություն նախատեսված ՉԷ:

-Այսինքն՝ Սահմանադրությունը Գլխավոր շտաբի պետին տալիս է հատուկ կարգավիճակ եւ չի լիազորում ո՛չ Հանրապետության նախագահին, ո՛չ վարչապետին Գլխավոր շտաբի պետին ազատելու հնարավորությամբ։

Ինչ վերաբերում է «Զինվորական ծառայության եւ զինծառայողի կարգավիճակի մասին» օրենքի 40-րդ հոդվածի 3-րդ մասին, որը նախատեսում է բարձրագույն հրամանատարական կազմի զինվորական պաշտոն զբաղեցնող պաշտոնատար անձանց պաշտոնից հայեցողական ազատելու հնարավորությունը, նախ՝ դա Գլխավոր շտաբի պետի վրա չի տարածվում, որովհետեւ ինչպես նշեցի Սահմանադրությունը նման հնարավորություն չի նախատեսում, իսկ Սահմանադրությունը վերադաս է օրենքի նկատմամբ, սահմանադրական մարմիններն էլ իրավասու են կատարելու միայն այնպիսի գործողություններ, որոնց համար լիազորված են Սահմանադրությամբ, 2-րդ՝ սահմանադիրն առանձնացրել է Գլխավոր շտաբի պետին զինված ուժերի և այլ զորքերի բարձրագույն հրամանատարական կազմից՝ նշելով, որ գլխավոր շտաբի պետը զինված ուժերի զինվորական ԱՄԵՆԱԲԱՐՁՐ պաշտոնատար անձն է եւ տալով նրան սահմանադրական հատուկ կարգավիճակ։

-Հետեւաբար՝ գլխավոր շտաբի պետին ազատելու կապակցությամբ մեկնարկած գործընթացն ինքնին հակաիրավական է, իսկ Օնիկ Գասպարյանը շարունակելու է պաշտոնավարել։

Նախորդիվ եւս անդրադարձել էի այս հարցին՝ հղումը մեկնաբանություններում»։
