Կալանքից այսօր ազատ արձակվեց «Գագիկ Սողոմոնյան» ֆեյսբուքյան օգտատիրջող գործով շուրջ 24 օր ապօրինի ազատազրկված, երեք անչափահաս երեխաների հայր Արամ Սարգսյանը: Այս մասին ֆեյսբուքյան իր էջում գրել է սահմանագրագետ Գոհար Մելոյանը:

«Վերջինիս առաջադրված անհեթեթ մեղադրանքի և ապօրինի ազատազրկման մասին բազմիզս փաստարկված խոսել է իր պաշտպան Բենիկ Գալստյանը։

Բավարար է միայն հիշատակել, որ Արամ Սարգսյանը 24 օր ապօրինի ազատազրկված է եղել ՀՀ քրեական օրենսգրքի 307.4-րդ հոդվածի հիման վրա (ռազմական դրության իրավական ռեժիմի ընթացքում տեղեկությունների հրապարակման կամ տարածման կանոնները խախտելը), այն դեպքում, երբ նշված կանոնների գործողությունը դեռ անցած տարի կասեցվել է Սահմանադրական դատարանի կողմից, այնուհետեւ՝ վերացվել ՀՀ կառավարության կողմից։

Արդյո՞ք որևէ պետական մարմին կամ պաշտոնատար անձ պատասխանատվություն չի կրելու այս խայտառակության համար։

Արդյո՞ք պետությունը չունի որևէ պարտավորություն կանխելու 24 օր ծայրահեղ անհիմն և ապօրինի ձևով անձի ազատազրկումը։

Եւ, վերջապես, ո՞վ է փոխհատուցելու անձին ապօրինաբար ազատությունից զրկելու, նրա եւ նրա ընտանիքի բնականոն կյանքը խաթարելու համար։

Այն դեպքում, երբ մինչ օրս Գլխավոր դատախազությունը չի բողոքարկել այս գործով մեղադրյալներ Կարեն Բեքարյանի և Մհեր Ավագյանի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու վերաբերյալ միջնորդությունը մերժելու մասին առաջին ատյանի ընդհանուր իրավասության դատարանի որոշումները, ինչպես նաեւ Արա Սաղաթելյանի ապօրինի կալանավորումը վերացնելու մասին վերաքննիչ դատարանի որոշումը՝ ըստ էության համաձայնվելով այդ որոշումների բովանդակության հետ, ինչու՞ սեփական նախաձեռնությամբ չի վերացրել Արամ Սարգսյանի կալանքը՝ անգործությամբ թույլ տալով, որ այդ քաղաքացին ևս մի քանի օր ազատությունից զրկված լինի։

Ավելին՝ մինչ այս պահը չկա որևէ պաշտոնական հաղորդագրություն Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի նախագահ Արթուր Մկրտչյանի կողմից տրված ապօրինի հրահանգի արդյունքում Արամ Սարգսյանին ազատազրկելու առերևույթ փաստական հանգամանքների վերաբերյալ, ինչը ևս մի անգամ հավաստում է դրա արժանահավատությունը։

Իշխող ուժի ներկայացուցիչներն ու արբանյակները շատ են սիրում խոսել իրենց կարծիքով «ապօրինի դատական ակտերի արդյունքում» տարբեր անձանց կալանքից ազատելու մասին, սակայն երբեք չեն խոսում ապօրինի դատական ակտերի արդյունքում տարբեր անձանց կալանավորման մասին»,- գրել է սահմանադրագետը։
