Հայաստանի ժուռնալիստների միության կոչը` ՀՀ նախագահին և ՄԻՊ-ին

Հայաստանի ժուռնալիստների միությունը (ՀԺՄ) հայտարարություն է տարածել, որում ասված է.

«Մարտի 24-ին Ազգային ժողովը երկրորդ ընթերցմամբ և ամբողջությամբ ընդունել է «ՀՀ քաղաքացիական օրենսգրքում փոփոխություններ կատարելու մասին» օրենքի նախագիծը՝ եռապատկելով վիրավորանքի և զրպարտության համար նախատեսվող դրամական փոխհատուցումը. վիրավորանքի համար՝ գործող 1 միլիոնի փոխարեն մինչև 3 միլիոն դրամ տուգանք, իսկ զրպարտության պարագայում՝ 2 միլիոն դրամի փոխարեն մինչև 6 միլիոն դրամ։

Այս փոփոխություններն ուղղակիորեն ուղղված են խոսքի ազատության և մամուլի դեմ ու տեղավորվում են զանգվածային լրատվության միջոցների, խոսքի ազատության հանդեպ գործող իշխանությունների քաղաքականության տրամաբանության շրջանակներում։ Վիրավորանքի ու զրպարտության համար նման՝ հայկական իրականության չափանիշերով աստղաբաշխական ծավալի տուգանքների սահմանմամբ ուղիղ հարված է հասցվելու առանց այդ էլ մեծ դժվարությամբ գոյատևող լրատվամիջոցներին՝ շատերին ընդհուպ կանգնեցնելով փակման սպառնալիքի առաջ։ 

Ընդ որում, մամուլին ուղղակիորեն առնչվող այս փոփոխություններն ընդունվել են դատական համակարգը վերահսկելի դարձնելու՝ իշխանությունների անթաքույց ցանկության ու նախաձեռնությունների պայմաններում, ինչը նշանակում է, որ տեսանելի ապագայում՝ ունենալով կառավարելի դատարաններ, իշխանությունները կարող են օգտագործել այդ օրենքը՝ իրենց ոչ հաճո լրատվամիջոցներին դատարանների միջոցով լռեցնելու նպատակով։  Բացի այն, որ ընդունված փոփոխություններն ունեն ակնհայտ քաղաքական նպատակներ, դրանք հակասում են նաև ՀՀ Սահմանադրությանն ու եվրոպական մի շարք կոնվենցիաներին։ 

Ընդունված օրենքին ընդդիմախոսությունն ամենևին չի նշանակում զրպարտության կամ վիրավորանքի խրախուսում, ինչի դեմ պայքարելու համար կարելի է և պետք է ընդունել այլ՝ մամուլի ազատությանը չվնասող իրավակարգավորումներ ու գործիքներ։ Մամուլի դեմ հերթական այս օրենքն ընդունվել է՝ առանց ոլորտի ներկայացուցիչների ու փորձագիտական հանրության տեսակետը հաշվի առնելու, ավելին՝ լրագրողական գրեթե բոլոր կազմակերպությունների  շրջանում կա կոնսենսուս՝ օրենքի անընդունելիության ու վտանգավորության հարցի վերաբերյալ, ինչը, սակայն, չխանգարեց իշխող մեծամասնությանը վավերացնել խոսքի ազատության դեմ ուղղված հերթական նախաձեռնությունը։ 

Խստագույնս դատապարտելով իշխանության կողմից խոսքի ազատության դեմ ուղղված խայտառակ այս օրենքը, Հայաստանի ժուռնալիստների միությունն արձանագրում է, որ տեսականորեն օրենքը կարող է ուժի մեջ չմտնել, եթե Հանրապետության նախագահը չստորագրի այն և ուղարկի Սահմանադրական դատարան՝ որոշելու դրա համապատասխանությունը ՀՀ Սահմանադրությանը։ Հաշվի առնելով նախագահ Արմեն Սարգսյանի՝ վերջին շրջանի գործունեությունը և իշխանության ներկայացրած ցանկացած նախագիծ ստորագրելու պատրաստակամությունը, այդ հնարավորությունը թվում է չափազանց անիրատեսական։ 

Այդուհանդերձ, Հայաստանի ժուռնալիստների միությունը ՀՀ նախագահին կոչ է անում՝ օգտվել օրենքը չստորագրելու իր սահմանադրական իրավունքից և կանխել ժողովրդավարության հիմնասյուներից մեկը համարվող խոսքի ու մամուլի ազատության դեմ ուղղված սույն նախաձեռնությունը։ 

Միևնույն ժամանակ Հայաստանի ժուռնալիստների միությունն արդեն իսկ ընդունված օրենքի առնչությամբ դիմում է Մարդու իրավունքների պաշտպան Արմեն Թաթոյանին՝ քննարկելու համար առկա իրավական գործիքակազմով ու ընթացակարգերով օրենքի սահմանադրականության վիճարկման հնարավորությունները»։
