«Մեկ Հայաստան» կուսակցության հիմնադիր նախագահ, իրավաբան Արթուր Ղազինյանը ֆեյսբուքյան իր էջում գրել է.

«Հրաժարականից հետո վարչապետի ժամանակավոր պաշտոնավարման սահմանադրականությունը քննարկելիս պետք է ելնել ստորև նշված ելակետային հիմնադրույթներից.

1. Վարչապետի հրաժարականը՝ որպես արտահերթ խորհրդարանական ընտրություններ անցկացնելու նախապայման ՀՀ Սահմանադրությունը չի նախատեսում։ Այլ կերպ ասած՝ վարչապետի հրաժարականը չի կարող հիմք լինել արտահերթ խորհրդարանական ընտրություններ անցկացնելու համար, քանի որ առաջնային մանդատով օժտված է ոչ թե վարչապետը, այլ Ազգային ժողովը։ Իսկ հրաժարականի պարագայում ՀՀ Ազգային ժողովն ունի երկու հնարավորություն ընտրելու նոր վարչապետ։

2. Արտահերթ խորհրդարանական ընտրությունները ոչ թե նպատակ են, այլ հետևանք։ Հետևանք է երկրում առկա քաղաքական ճգնաժամի, երբ վարչապետը, իր պարտականությունների կատարման անհնարինության պայմաններում ներկայացնում է հրաժարական, իսկ Ազգային ժողովին չի հաջողվում երկու շաբաթվա ընթացքում ձևավորել նոր կայուն մեծամասնություն և ձևավորել նոր կառավարություն։ Եթե հնարավոր է վարչապետի պարտականություններն ամբողջ ծավալով իրականացնել, ապա հրաժարական ներկայացնելու որևէ պատճառ չկա, իսկ եթե ներկայացվել է հրաժարական, ուրեմն առկա է պարտականությունների կատարման անհնարինություն։

3. Արտահերթ ընտրություններ անցկացնելու նպատակով «տեխնիկական» հրաժարական ՀՀ Սահմանադրությունը չի նախատեսում, դա հորինել է Նիկոլ Փաշինյանը՝ սպառնալիքի ու շանտաժի ուժով Ազգային ժողովի նոր վարչապետ ընտրելու իշխանությանը տիրանալու և այն «իրավունքի ուով» արձակելու նպատակով։ Խորհրդարանական կառավարման համակարգում վարչապետի հրաժարականը իր պարտականությունները կատարելու անհնարինության ՀԵՏԵՎԱՆՔ է, որը կարող է առաջանալ ինչպես քաղաքական, այնպես էլ անձնական դրդապատճառներով։

4. ՀՀ Սահմանադրությամբ հրաժարականը սահմանված կարգով ընդունվելու և հաստատվելու դեպքում հրաժարական ներկայացրած կառավարության անդամը ազատվում է զբաղեցրած պաշտոնից և չի կարող շարունակել իր պաշտոնավարումը՝ կառավարության անդամի, այս դեպքում վարչապետի պարտականությունների կատարման անհնարինության ուժով։

5. Վերջապես, հրաժարական ներկայացրած կառավարության անդամը պետք է ՏՂԱՄԱՐԴ լինի և արժանապատիվ կերպով հեռանա՝ խոստովանելով իր դավաճան, ստախոս, դիլետանտ և ապիկար լինելը»։

Հրաժարականից հետո վարչապետի ժամանակավոր պաշտոնավարման սահմանադրականությունը քննարկելիս պետք է ելնել ստորև նշված...
