«Ազգային ժողովի հապճեպորեն հրավիրված արտահերթ նիստում ներկայացվող «ընտրական փաթեթի» ընդունումը նպատակ ունի նախընտրական գործընթացներում ակնհայտորեն բարելավել իշխող ուժի դիրքերը։
 
Օրինակ՝ նախագծով ՀՀ քրեական օրենսգրքրի 154.10-րդ հոդվածով քրեական պատասխանատվություն է սահմանվում կուսակցության կամ պատգամավորության թեկնածուի վերաբերյալ անանուն աղբյուրի միջոցով «կեղծ» տեղեկություններ հրապարակելու համար։
 
Այսինքն, իշխանությունների կամակատար հանդիսացող իրավապահ մարմիններն են որոշելու, թե անանուն աղբյուրի կողմից առանձին կուսակցության կամ պատգամավորի վերաբերյալ տարածված որ տեղեկությունն է կեղծ և որն է իրական։
 
Արդյունքում, ԱԿՆՀԱՅՏ է՝ քննչական մարմինները անանուն աղբյուրների կողմից «Քաղաքացիական պայմանագիր» կուսակցության կամ վերջինիս պատգամավորների վերաբերյալ տարածվող տեղեկությունները համարելու են կեղծ, և դրանք տարածած ԶԼՄ-ների գործողությունների փաստով հարուցելու են քրեական գործեր, իսկ ընդդիմադիր կուսակցությունների վերաբերյալ հանրահայտ հարթակներում (oրինակ՝ perfect tv-ով) տարածվող տեղեկությունները չեն որակվելու կեղծ (հաշվի առնելով, արդեն իսկ, գործող պրակտիկան) և որևէ քրեական գործ չի հարուցվելու, իսկ հարուցվելու դեպքում էլ դրանք քննվելու են յուրահատուկ դանդաղկոտությամբ։
Ամփոփելով ընդգծենք՝ նշված նախագիծը տեղեկատվության տարածման իրավունքի դեմ գործող իշխանությունների կողմից իրականացվող ՀԵՐԹԱԿԱՆ բացահայտ քայլն է և էականորեն սահմանափակելու է ԶԼՄ-ների գործունեությունը սպասվող ընտրարշավի ընթացքում։
 
Նախագծով որևէ հիմնավորում չկա, թե ինչու անանուն աղբյուրի կողմից կուսակցության վերաբերյալ տեղեկությունների հրապարակման համար պետք է սահմանվի քրեական, այլ ոչ օրինակ՝ վարչական պատասխանատվություն։
Հատկապես, երբ առաջարկվող հոդվածի սանկցիան որպես պատժատեսակ նախատեսում է բացառապես տուգանքը։
 
Նշված նախագիծն խնդրահարույց է նաև իրավական որոշակիության տեսանկյունից, քանի որ պարզ չէ, թե ժամանակագրական առումով այն որ ժամանակահատվածի նկատմամբ է տարածվում է, օրինակ՝ բացառապես նախընտրական քարոզարշավի ընթացքի, այսինքն՝ հունիսի 6-ից մինչև հունիսի 18-ի, թե այն պահից, երբ այս կամ այն կուսակցությունը պաշտոնապես հայտարարում է ընտրություններին իր մասնակցության վերաբերյալ կամ համապափասխան փաթեթը ներկայացնում է ԿԸՀ»։
