Երբ երեք տարի առաջ վարչապետի իրավաբանները ներկայացրել են մի հիմնավորում և երեք տարի անց տալիս են ճիշտ հակառակը՝ իրավագիտության մեջ դա կոչվում է վերլուծական շիզոֆրենիա, այսինքն՝ պետական մարմինների համար անթույլատրելի է, որն ամբողջությամբ փոշիացնում է նրանց վարկանիշը և պետականությունը: Այս մասին ասյօր՝ ապրիլի 30-ին, կայացած քննարկման ժամանակ ասաց ԵՊՀ սահմանադրական իրավունքի ամբիոնի վարիչ, «Երորրդ ուժ» քաղաքացիական նախաձեռնության անդամ Վարդան Այվազյանը:

Այվազյանը անդրադարձավ Նիկոլ Փաշինյանի պաշտոնավարման իրավունքներին. «Վարչապետի կողմնակիցները փորձում  են Սահմանադրության տեխնիկական տառացի մեկնաբանություն տալ՝ Սահմանադրության, մասնավորապես, 158-րդ հոդվածի, ըստ որի, կառավարության անդամները շարունակում են կատարել իրենց պարտականությունները, սակայն պետք է հասկանալ սահմանադրական այս դրույթը ինչ իմաստ ունի, և այն պետք է մեկնաբանել բովանդակության առումով: Ինչպես Սահմանադրության 158-րդ հոդվածը, այնպես էլ կառավարության կառուցվածքի և գործունեության մասին օրենքը հստակ ամրագրում են վարչապետի և կառավարության հրաժարականի հիմքերը և այս առումով բացարձակապես չի կարելի միմյանց հետ շփոթել վարչապետի ու կառավարության հրաժարականները»:

Ըստ Այվազյանի՝ երբ կառավարությունն է հրաժարական տալիս, ապա որոշակի առումով տրամաբանական է, որ վարչապետի գլխավորությամբ կառավարության անդամները մնան ժամանակավոր պաշտոնակատար և իրականացնեն իրենց պարտականությունները՝ մինչև կձևավորվի նոր կառավարություն: 

«Երբ վարչապետն է տալիս հրաժարական, ապա դա տրամաբանորեն ենթադրում է վարչապետի լիազորությունների կատարման անհնարինություն և այս դեպքում իրավական լուծումը պետք է լիներ այն, որ կառավարությունը՝ օրենքով սահմանված կարգով, փոխվարչապետներից որևէ մեկին նշանակեր վարչապետի ԺՊ»,- ընդգծեց բանախոսը:
