Կրթության, գիտության, մշակույթի և սպորտի նախարարությունը ՀՀ կառավարության միասնական տեղեկատվական e-draft.am հարթակում հանրային քննարկման է ներկայացրել մի շարք պետական բարձրագույն ուսումնական հաստատությունների կառավարման խորհուրդների ձևավորման կարգը փոփոխելու վերաբերյալ նախագիծ:

ԿԳՄՍՆ-ից հայտնում են, որ նախատեսվող նոր կարգավորմամբ առաջարկվում է փոփոխություն կատարել հիմնադրամի կազմակերպական-իրավական ձև ունեցող պետական բարձրագույն ուսումնական հաստատությունների կանոնադրություններում, մասնավորապես նվազեցնել կառավարման խորհուրդների անդամների թիվը:

Նմանօրինակ փոփոխության անհրաժեշտությունը, ըստ նախագծին կից ներկայացված հիմնավորման, պայմանավորված է բուհական համակարգի կառավարման արդյունավետության բարձրացմամբ և բարձրագույն կրթության բնագավառում իրականացվող բարեփոխումներով:

ՀՀ կրթության, գիտության, մշակույթի և սպորտի նախարարության 16 պետական բարձրագույն ուսումնական հաստատություններից 12-ը ներկայում ունեն հիմնադրամի կազմակերպական-իրավական ձև:

 Դրանց գործունեությունը կարգավորվում է «Հիմնադրամների մասին», «Բարձրագույն և հետբուհական մասնագիտական կրթության մասին» օրենքներով, ինչպես նաև համապատասխան բուհի կանոնադրությամբ, որը հաստատվում է հիմնադրի, այսինքն` ՀՀ կառավարության  կողմից:

Բուհերի կանոնադրություններում այժմ սահմանված են խորհուրդների տարբեր թվաքանակներ՝ 32 կամ 24 հոգի: Առաջարկվում է բոլոր խորհուրդների դեպքում ունենալ ընդհանուր մոտեցում` սահմանելով 20 հոգուց բաղկացած կառավարման խորհուրդ, որը համահունչ է «Բարձրագույն և հետբուհական մասնագիտական կրթության մասին» օրենքի 15-րդ հոդվածի 2-րդ մասի պահանջներին, որտեղ սահմանվում է, որ խորհրդի ձևավորման կարգը լիազորված մարմնի ներկայացմամբ սահմանում է ՀՀ կառավարությունը: Խորհրդի թվաքանակը սահմանվում է տվյալ բուհի կանոնադրությամբ՝ առնվազն 20 հոգի:

Բուհերի կառավարման խորհուրդներում ներկայացուցչական համամասնությունը  ներկայում բաշխված է հավասարապես՝ խորհրդի ձևավորող յուրաքանչյուր կողմին (պրոֆեսորադասախոսական կազմ, ուսանողության, հիմնադրի և լիազորված մարմնի ներկայացուցիչներ) 25 տոկոս: Նախագծով առաջարկվում է վերանայել և սահմանել ներկայացվածության հետևյալ բաշխվածությունը՝ հիմնադրի կողմից 55 տոկոս կամ 11 հոգի, պետական կառավարման լիազոր մարմնի կողմից` 10 տոկոս  կամ 2 հոգի, բուհի պրոֆեսորադասախոսական կազմից՝ 10 տոկոս  կամ 2 հոգի, ուսանողական համակազմի ներկայացուցիչներից՝ 25 տոկոս  կամ 5 հոգի:

Այդ փոփոխությունը կատարվում է հետևյալ հիմնավորմամբ. «Ներկայացվածության նման բաշխվածությունը բացասաբար է անդրադառնում հոգաբարձուների խորհուրդների՝ կառավարչական որոշումներ կայացնելու օպերատիվության վրա, որոշ դեպքերում հանգեցնում խորհուրդների նախագահների և ռեկտորների ընտրության գործընթացի արգելափակմանը՝ տարբեր բուհերում խորհուրդները դարձնելով խմբային շահերի հակամարտության հարթակ և փաստացի կաթվածահար անելով հաստատության բնականոն գործունեությունը։

Պետք է նշել նաև, որ գործող համամասնությունները որոշակիորեն սահմանափակում են կառավարության՝ որպես պետական հիմնադրամների հիմնադրի հնարավորությունները համակարգում իրականացվելիք բարեփոխումների ընթացքը կառավարելու առումով»։

Նախագծի վերաբերյալ իրենց դիտողություններն ու առաջարկությունները ՀՀ պետական բուհերը, ոլորտում գործող հասարակական կազմակերպություններն ու հետաքրքրված անձինք կարող են ներկայացնել մինչև 2021 թվականի մայիսի 14-ը:
