ՀՀ գլխավոր դատախազ Արթուր Դավթյանը բացառում է դատախազության կողմից քաղաքական որոշումների կայացումը: Նա այս մասին վստահեցրեց ԱԺ-ում լրագրողների հետ զրույցում՝ անդրադառնալով հարցին, թե ինչն է պատճառը, որ երբ դատախազությունը փորձում է ինչ-որ անձանց կալանավորել՝ տարբեր գործերով, վերջում դատական համակարգը որոշում է, որ դա ոչ իրավաչափ գործողություն է, հնարավո՞ր է, որ դատախազությունը քաղաքական որոշումներ է կայացնում:

«Բացառված է, որ մենք քաղաքական որոշումներ կայացնենք»,-ասաց Դավթյանն ու հավելեց, որ իրավական գործընթացների բացերը, թերությունները ԱԺ-ում՝ «Հայաստանի Հանրապետության դատախազության 2020 թվականի գործունեության մասին» հաղորդման մեջ շատ մանրամասն ներկայացրել է:

Նրա կարծիքով՝ մինչդատական վարույթում ձերբակալումների և կալանավորումների հետ կապված խնդիրների զգալի մասը պայմանավորված է օրենսդրական խնդիրներով: «Մի որոշակի մասը պայմանավորված է հատկապես դատական մարմինների կողմից մեզ համար  անկանխատեսելի, միջազգային պրակտիկային անհամաչափ, անհամապատասխան մեկնաբանություններ տալով»,-ասաց Դավթյանը:

Անդրադառնալով վարչապետ Նիկոլ Փաշինյանի՝ Սյունիքի մարզ կատարած այցի ընթացքում տեղի ունեցած միջադեպի առիթով հարուցված գործին՝ դատախազը վստահեցրեց, որ  քաղաքական որոշման մասին խոսք լինել չի կարող: «Կատարված դեպքերն էլ եղել են հրապարակային: Յուրաքանչյուր քաղաքացի կարող է կատարված դեպքը դնել, նայել ու հասկանալ՝ դրա վերաբերյալ քրեական վարույթը, քրեական հետապնդումն արդարացված է, թե ոչ՝ ոչ միայն իրավական առումով»,-ասաց նա:

Դավթյանի խոսքով՝ Սյունիքի դեպքերով դատարանների կողմից տրված գնահատականների ճնշող մեծամասնության հետ իրենք համաձայն չենք եղել և հիմա վիճարկում են դրանք վերադաս դատարաններում:
