«Համաձայն ՀՀ Սահմանադրության 4-րդ հոդվածի Պետական իշխանությունն իրականացվում է Սահմանադրությանը և օրենքներին համապատասխան՝ օրենսդիր, գործադիր և դատական իշխանությունների բաժանման ու հավասարակշռման հիման վրա:
Փաստացի մենք ունենք հետևյալ իրավիճակը․ 2021 թվականի մայիսի 3-ին և 10-ին ՀՀ Ազգային ժողովի կողմից ՀՀ վարչապետ չընտրելու հետևանքով Ազգային ժողովն արձակվել է իրավունքի ուժով, այսինքն` Հայաստանի Հանրապետությունը չունի օրենսդիր իշխանություն։
Հանրապետության նախագահի 2021 թվականի ապրիլի 25-ի թիվ ՆՀ-80-Ա հրամանագրով ընդունվել է Կառավարության հրաժարականը, այսինքն` Հայաստանի Հանրապետությունը չունի գործադիր իշխանություն, ավելին` ՀՀ վարչապետի պաշտոնն ապօրինի կերպով զավթված է նախկին վարչապետ Նիկոլ Փաշինյանի կողմից։
Բարձրագույն դատական խորհրդի (ԲԴԽ) նախագահ Ռուբեն Վարդազարյանի լիազորությունները կասեցված են և նա զրկված է իր պաշտոնական պարտականությունները կատարելու հնարավորությունից։ Նրա փոխարեն ԲԴԽ-ի նախագահի պարտականությունները ժամանակավորապես կատարում է Գագիկ Ջհանգիրյանը, ով տարիքային ցենզի իմաստով, իրավունք չունի հանդիսանալ ԲԴԽ անդամ, ավելին, նա ԲԴԽ-ի անդամի պաշտոնում ընտրվել է որպես իրավաբան-գիտնական այն դեպքում, երբ Բարձրագույն որակավորման կոմիտեի պաշտոնական կայքում բացակայում է տեղեկատվություն՝ նրա գիտական աստիճան ունենալու, այսինքն՝ գիտնական լինելու վերաբերյալ։
2020 թվականի հունիսի 26-ից ապօրինի կերպով դադարեցվել են Սահմանադրական դատարանի նախագահ Հրայր Թովմասյանի լիազորությունները, որից հետո մինչ օրս Սահմանադրական դատարանը որոշում չի կայացրել ՍԴ նախագահ ընտրելու վերաբերյալ, ավելին ՍԴ դատավորներից մեկը՝ Արման Դիլանյանը ապօրինի կերպով զավթել է ՍԴ նախագահի լիազորությունները (մինչ այդ ՍԴ նախագահի պաշտոնում ինքնահռաչկվել էր ՍԴ դատավոր Աշոտ Խաչատրյանը)։
Փաստորեն 2021 թվականի մայիսի 10-ի դրությամբ Հայաստանը զրկված է օրենսդիր, գործադիր և դատական իշխանությունից, ավելի այդ իշխանությունները նաև ապօրինի կերպով զավթված ու յուրացված են։ Համավարակի և հետպատերազմյան բարդ իրավիճակում մեր երկիրը նման վիճակի մեջ կարող էին դնել միայն Հայաստանի թշնամիները։
