Ընտրացուցակ կազմելիս ի՞նչ դրույթներ պետք է պահպանել․ Կոռուպցիայի կանխարգելման հանձնաժողով

Ազգային ժողովի առաջիկա ընտրություններին ընդառաջ Կոռուպցիայի կանխարգելման հանձնաժողովը ընտրությանը մասնակցող բոլոր կուսակցություններին, դաշինքներին հարկ է համարում հիշեցնել, որ պատգամավորները չեն կարող զբաղվել ձեռնարկատիրական գործունեությամբ, զբաղեցնել որևէ պաշտոն` առևտրային կազմակերպություններում և որևէ այլ կերպ խախտել պատգամավորի մանդատի հետ անհամատեղելիության պահանջները: Անհամատեղելիության պահանջները խախտելը պատգամավորի լիազորությունների դադարեցման հիմք է։

Հայաստանի Հանրապետությունում պատգամավորի մանդատի հետ անհամատեղելիության պահանջը, այդ թվում՝ ձեռնարկատիրական գործունեությամբ զբաղվելու արգելքը, սահմանվել է Սահմանադրությամբ դեռևս 2005 թվականից։ Սահմանադրական նման դրույթն ապահովում է իշխանությունների տարանջատման և հավասարկշռման սկզբունքի պահպանումը, կանխում է հովանավորչությունը, պետական պաշտոնից բխող պարտականությունների իրականացման վրա հնարավոր ազդեցությունները, ինչպես նաև քաղաքականության ու բիզնեսի սերտաճումը։

Կոռուպցիայի կանխարգելման հանձնաժողովը հետևողական է անհամատեղելիության պահանջների պահպանումը վերահսկելու գործընթացում և հորդորում է բոլոր քաղաքական ուժերին ընտրական ցուցակներ կազմելուց առաջ և հետագա ողջ գործունեության ընթացքում խստորեն պահպանել Սահմանադրության դրույթները, իսկ հարցերի և պարզաբանումների համար դիմել Հանձնաժողով։

Տեղեկացնենք նաև, որ 2020 թվականին Կոռուպցիայի կանխարգելման հանձնաժողովը իրականացրել է պաշտոնատար անձանց ներկայացվող անհամատեղելիության պահանջների պահպանման ուսումնասիրություն, որի ընթացքում ստուգվել է առևտրային կազմակերպություններում, ինչպես նաև դրանց կառավարման մարմիններում այդ անձանց հնարավոր ներկայացվածությունը։

Հանձնաժողովը ստուգել է ինչպես հայտարարագրված, այնպես էլ չհայտարարագրված առևտրային կազմակերպությունների՝ Հանձնաժողովին հասանելի դարձած փաստաթղթերը, ուսումնասիրել է Հանձնաժողով ներկայացրած հավատարմագրային կառավարման պայմանագրերը։ Այդ ուսումնասիրությունների արդյունքում արդեն իսկ հայտնաբերվել է օրենքի առերևույթ խախտման 9 դեպք։
