ՄԻՊ Արման Թաթոյանն իր ֆեյսբուքյան էջում գրել է․

«Խիստ մտահոգիչ են ՀՀ քրեական օրենսգրքի 149.1-րդ հոդվածի 2021թ. ապրիլի 28-ի փոփոխությունները: Այդ հոդվածը պատասխանատվություն է նախատեսում «նախընտրական քարոզչությանը մասնակցելուն կամ հանրաքվեի քարոզչություն կատարելուն կամ նախընտրական քարոզչությանը մասնակցելուց կամ հանրաքվեի քարոզչություն կատարելուց հրաժարվելուն հարկադրելու կամ նախընտրական քարոզչությանը մասնակցելուն կամ հանրաքվեի քարոզչություն կատարելուն որևէ եղանակով խոչընդոտելու համար»:
 
Հոդվածի փոփոխությունները Քրեական օրենսգրքում ամրագրվել են շատ հապճեպ, նախագիծն ԱԺ նստաշրջանի օրակարգ է ընդգրկվել և առաջին, երկրորդ ընթերցումներով ու ամբողջությամբ ընդունվել մեկ օրում՝ 2021 թվականի ապրիլի 28-ին, առանց մասնագիտական ու պատշաճ հանրային քննարկումների, հրապարակված չի եղել «e-draft.am» կայքում, նախագծային փուլում առկա են եղել են մի քանի տարբերակներ:
 
Հիմնավորումները խիստ մակերեսային են, մարդու իրավունքների խախտումների վտանգներով, ցույց տված չեն օրենսդրի մտադրության և իրավապահ մարմինների ու դատարանի հայեցողության սահմանները փոփոխությունները կիրառելու հարցում: Մատնանշված չէ որևէ երկրի փորձ, ցույց տված չէ, թե այդ ինչ միջազգային պահանջների հիման վրա են կատարվում այդ փոփոխությունները և վերլուծված չեն մարդու իրավունքների տեսսնկյունից ռիսկերը:
 
Դրա համար էլ, ինչպես վկայում են բողոքներն ու ահազանգերը, պրակտիկայում հիմա ստացել է խնդրահարույց ու անտրամաբանական կիրառություն: Քրեական օրենսգրքի նշված հոդվածի փոփոխությունից հետո իրավապահ մարմինների ու դատարանների համար այդպես էլ գործնական որևէ չափանիշ կամ ուղեցույց չընդունվեց:
Իրավապահ մարմիններն իրենք են պարզաբանումներում ներկայում նշում, որ հասկանալիորեն չունեն կիրառության փորձ և դիրքորոշում էլ չեն կարող հայտնել կիրառության վերաբերյալ:
 
Քանի որ Քրեական օրենսգրքի այդ փոփոխությունները այն էլ արտահերթ խորհրդարանական ընտրութունների շրջանակում կիրառվելու էին շատ կարճ ժամանակահատվածի համար, վերաբերում են մարդու իրավունքների տեսանկյունից զգայուն հարցերի հատկապես չէր կարելի դրանք ընդունել առանց պատշաճ քննարկումների ու նման թերություններով` առավել ևս առանց իրավապահ մարմիննների ու դատարանի պատշաճ վերապատրաստումների կամ առնվազն նրանց համար ուղեցույցերի:
 
Հաշվի առնելով հոդվածի փոփոխության ընթացակարգային լուրջ թերությունները, բովանդակային խնդիրները, ինչպես նաև կիրառության պրակտիկան՝ ներկայում պատրաստվում է Մարդու իրավունքների պաշտպանի դիմում՝ ուղղված Սահմանադրական դատարանին»:
