ՀՀ դատախազությունը հետևողական է լինելու Մարտակերտի բնակչի սպանության և հրադադարի կոպիտ խախտման դեպքի քննության հարցում

2021թ հոկտեմբերի 9-ին, ժամը 13։20-ի սահմաններում Մարտակերտի քաղաքային համայնքի վարչական տարածքում տեղակայված վարելահողում գյուղատնտեսական տեխնիկայով աշխատանքներ կատարելիս մոտավորապես մեկ կիլոմետր հեռավորությամբ տեղակայված ադրբեջանական դիրքից արձակված կրակոցից կրծքավանդակի հատվածում վիրավորվել ու տեղում մահացել է Մարտակերտ քաղաքի բնակիչ, 1966թ․ ծնված Արամ Ալեքսեյի Տեփնանցը։

ՀՀ գլխավոր դատախազությունից  հայտնում են, որ նախքան գյուղատնտեսական աշխատանքներն սկսելը, հաշվի առնելով տեղանքի սահմանամերձ լինելը, Մարտակերտի քաղաքային համայնքի և ԱՀ ՊԲ ներկայացուցիչների միջնորդությամբ այդ տեղանք էին ներկայացել  ռուս խաղաղապահները՝ աշխատանքների անվտանգությունն ապահովելու համար։ Ըստ նախնական տեղեկությունների՝ վարորդը սկզբում խուսափել է վարել գյուղտեխնիկան, սակայն խաղաղապահներից մեկը առաջարկել է նրա հետ անձամբ նստել խցիկում՝ որպես անվտանգության լրացուցիչ երաշխիք։ Ըստ ականատեսների պնդման՝ այդ եղանակով նրանք մի քանի պտույտ են կատարել։

Փաստի առթիվ նույն օրը հարուցվել է քրեական գործ՝ ԱՀ քրեական օրենսգրքի 103-րդ հոդվածի 2-րդ մասի 14-րդ կետով նախատեսված հանցագործության հատկանիշներով /սպանություն, որը կատարվել է ազգային, ռասայական կամ կրոնական ատելության կամ կրոնական մոլեռանդության շարժառիթով/։ Իրականացվում է նախաքննություն:

Դեպքից հետո գյուղատնտեսական աշխատանքները դադարեցվել են ոչ միայն այդ, այլև սահմանամերձ այլ հատվածներում։

Հաշվի առնելով հայ֊ադրբեջանական շփմագ գոտում արձանագրվող հանցավոր դեպքերի վերաբերյալ տեղեկատվությունն օպերատիվ փոխանակելու մասին Հայաստանի Հանրապետության, Ռուսաստանի Դաշնության և Ադրբեջանի Հանրապետության գլխավոր դատախազների միջև  ձեռք բերված պայմանավորվածությունը՝ Ադրբեջանի զինված ուժերի կողմից հրադադարի կոպտագույն խախմամբ քաղաքացիական անձի սպանության դեպքի վերաբերյալ առկա տվյալները փոխանցվել են Արցախում տեղակայված ՌԴ դատախազության ներկայացուցիչներին, նրանց հետ ապահովվել է օպերատիվ և արդյունավետ համագործակցություն։  Լիարժեք պատրաստակամություն է հայտնվել  ներգրավվելու դեպքի հետաքննությանը հնարավոր բոլոր ձևաչափերով, ինչի անհրաԺեշտության մասին ՀՀ գլխավոր դատախազը շեշտել է բազմիցս։

Նշված դեպքը 2020թ. նոյեմբերի 10-ին ՀՀ, ՌԴ և ԱՀ ղեկավարների միջև ստորագրված հրադադարի եռակողմ հայտարարության դրույթների կոպտագույն խախտում է:

ՀՀ գլխավոր դատախազությունը հետևողական է լինելու ձեռք բերված պայմանավորվածությունների իրագործմանը՝ հստակ դիրքորոշմամբ, որ սույն և նմանատիպ այլ դեպքերով օբյեկտիվ ու արդյունավետ քննությամբ մեղավոր անձանց արդարացի քրեական պատասխանատվության ապահովմամբ է հնարավոր ստեղծել կայուն երաշխիքներ նմանատիպ ողբերգական դեպքերը բացառելու համար և հստակ ամրագրելու հրադադարի խախտման և հանցավոր յուրաքանչյուր արարքի համար պատասխանատու կողմին՝ դրանից բխող իրավական հետևանքներով։
