ՊԵԿ-ն առաջարկում է վերանայել տրանսֆերային գնագոյացմանը վերաբերվող կանոնակարգումները

Պետական եկամուտների կոմիտեն առաջարկում է վերանայել տրանսֆերային գնագոյացմանը վերաբերվող կանոնակարգումները: ԱԺ տնտեսական հարցերի մշտական հանձնաժողովի հերթական նիստում այս մասին ասաց ՀՀ պետական եկամուտների կոմիտեի նախագահ Ռուստամ Բադասյանը` ներկայացնելով Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություններ եւ լրացումներ կատարելու մասին նախագիծը:

«Ընդհանուր առմամբ, նախագծի նպատակն է արդեն իսկ սահմանված կարգավորումները համապատասխանեցնել միջազգային մոտեցումներին, ինչպես նաեւ սահմանել հարկային հսկողություն իրականացնելու ընթացակարգերը»,- ասաց Բադասյանը:

Ըստ Բադասյանի` նախագծի ընդունումը պայմանավորված է տրանսֆերային գնագոյացման կարգավորումների լիարժեք եւ արդյունավետ ներդրման, ինչպես նաեւ վերջիններիս կիրառման համար համապատասխան իրավական կարգավորումներ սահմանելու անհրաժեշտությամբ:

Նախագծում նշվում է, որ տրանսֆերային գնագոյացման կիրառման տեսանկյունից չհաջողված փորձ է համարվում ավելացված արժեքի հարկով հարկվող գործարքների նկատմամբ տրանսֆերային գնագոյացման կարգավորումների կիրառումը, ուստի նախագծով առաջարկվում են համապատասխան փոփոխությունների իրականացում, հստակեցվել է տրանսֆերային գնագոյացման կարգավորումների կիրառման շրջանակները, մասնավորապես հստակեցվել է մշտական հաստատության միջոցով Հայաստանի Հանրապետությունում գործունեություն իրականացնող ոչ ռեզիդենտ շահութահարկ վճարողների նկատմամբ տրանսֆերային գնագոյացման կիրառման առանձնահատկությունները: Այս հստակեցումը կարեւոր նշանակություն ունի համաչափ հարկային վարչարարություն իրականացնելու տեսանկյունից, քանի որ դուստր կազմակերպությունների եւ մշտական հաստատությունների միջոցով ՀՀ-ում գործունեություն իրականացնող անձանց միջեւ ստեղծվում էր խտրական մոտեցում:

«Տրանսֆերային գնագոյացման կարգավորումների կիրառման համար կարեւորագույն բաղադրիչ է փոխկապակցված անձ համարվելու չափանիշների համակարգը, ինչը ամբողջությամբ վերանայվել է»,- ավելացրեց Բադասյանը:

Ակնկալվում է, որ  նախագիծը կնպաստի տրանսֆերային գնագոյացման կարգավորումների համապատասխանեցմանը միջազգային մոտեցումներին, հարկային հսկողության իրականացման համար անհրաժեշտ իրավական դաշտի ապահովմանը, հարկ վճարող-հարկային մարմին հարաբերության թափանցիկության մակարդակի բարձրացմանը, ինչպես նաեւ կկանխի հարկվող բազայի քայքայման եւ շահույթի տեղաշարժի փորձերը: Նախագծով ակնկալվում է տրանսֆերային գնագոյացման կարգավորումների ուղղությամբ ՀՀ ՊԵԿ կողմից իրականացվող վարչարարության բարելավումը: Նախագիծը կխթանի նաեւ փոխկապակցված հարկ վճարողների միջեւ միջսահմանային գործարքների պայմանների, դրանց դիմաց ստացված եկամուտների եւ առաջացված հարկվող բազայի ճշգրիտ ներկայացմանը եւ հարկմանը:
