Հանցավորության դեմ պայքարի արդյունավետությունը, ի թիվս այլ հանգամանքների, մեծապես պայմանավորված է նաև իրավապահ մարմինների փոխգործակցության որակից, համակարգի ծառայողների մասնագիտական ունակություններից ու հաստատակամությունից, օրինականության և իրավունքի պաշտպանության վեհ գործին ծառայելու պատրաստակամությունից:

Արցախի դատախազությունից հայտնում են, որ դժբախտաբար ԱՀ իրավապահ համակարգը զերծ չէ սեփական առաքելության բովանդակությանը հակադիր կեցվածք ունեցող ծառայողներից, որպիսի երևույթների դեմ պայքարը պետք է լինի բոլորիս խնդիրը:

Վերջերս ԱՀ քննչական կոմիտեի քննիչի վարույթում քննվող քրեական գործով նախաձեռնվել էր ենթադրյալ հանցանք կատարած անձի հեռախոսային խոսակցության լսում՝ նշված անձի կողմից կատարվող հանցագործությունների դեպքերը բացահայտելու համար:

ԱՀ ազգային անվտանգության ծառայության, ոստիկանության և քննչական կոմիտեի համագործակցության շրջանակում ձեռնարկված միջոցառումների, ինչպես նաև հիշյալ քննչական գործողության կատարման արդյունքում պարզվել է, որ ոստիկանության ծառայողը ոստիկանություն դիմած անձի՝ հանցագործության վերաբերյալ հաղորդումը գրանցելու և ընթացքավորելու փոխարեն, արտաիրավական ճանապարհով, ենթադրյալ հանցանք կատարած անձին «լավություն» անելու և սեփական հնարավորություններն ընդգծելու նպատակով փորձել է «հարթել» քաղաքացու իրավունքի խախտումը և ենթադրյալ հանցագործությամբ քաղաքացուն պատճառված վնասի հատուցումը՝ այդ կերպ վնաս հասցնելով իրավապահ համակարգի հեղինակությանը, նպաստելով ենթադրյալ հանցանք կատարած անձի՝ քրեական պատասխանատվությունից խուսափելուն:

Ոստիկանության հիշյալ ծառայողն ազատվել է զբաղեցրած պաշտոնից, դեպքի առթիվ հարուցվել է քրեական գործ, իրականացվում է նախաքննություն:
