Վարչապետի գլխավորությամբ կայացած միջգերատեսչական քննարկումների արդյունքներով նպատակահարմար չի համարվել ծանր վիրավորանքի ամրագրումը նոր Քրեական օրենսգրքում. այդ անընդունելի երևույթի համար կպահպանվի միայն քաղաքացիական պատասխանատվությունը` մինչև 3.000.000 դրամի չափով. ֆեյսբուքյան գրառմամբ տեղեկացնում է ՀՀ արդարադատության նախարար Կարեն Անդրեասյանը:

«Սույն թվականի հուլիսի 1-ից ուժի մեջ մտնող Քրեական օրենսգիրքը այլևս պատասխանատվություն չի նախատեսում ծանր վիրավորանքի համար: Ծանր վիրավորանքի համար քրեական պատասխանատվությունը նախատեսվել էր հասարակության խոր բևեռացման պայմաններում առանձին խմբերի և անհատների խայտառակ անընդունելի վարքագիծը զսպելու նպատակով:

Որքան էլ առանձին քաղաքական շրջանակներ հայտարարում էին ծանր վիրավորանքի քրեաիրավական նոր կարգավորման հակասահմանադրականության մասին, այդուհանդերձ, Սահմանադրական դատարանը հստակ արձանագրեց, որ այն լիովին համապատասխանում է Սահմանադրությանը: Վարչապետի գլխավորությամբ կայացած մի շարք մասնագիտական քննարկումների արդյունքում կառավարությունը գտել է, որ հետագա ժողովրդավարացման մեր օրակարգում խոսքի ազատության նույնիսկ իրավաչափ սահմանափակումը պետք է հնարավորինս իրականացնել առանց քրեական հետապնդման գործիքակազմի:

Գործադիրը նպատակահարմար չի գտել ծանր վիրավորանքի ամրագրումը նոր Քրեական օրենսգրքում` նախընտրելով այդ անթույլատրելի երևույթի համար արդեն իսկ գործող քաղաքացիական պատասխանատվության կարգավորումները:

Կառավարությունը շարունակելով խոսքի ազատության պաշտպանության իր հանձնառությունը` նախատեսում է նաև միջազգային լավագույն փորձը հաշվի առնող օրեսնդրական միջոցներ ձեռնարկել` պաշտպանելու նաև անձանց արժանապատվությունը, մասնավոր կյանքը, ազգային անվտանգությունը և այլ չափազանց կարևոր արժեքներ ազատ արտահայտման չարաշահումներից: Ի թիվս այլ քայլերի, 2022 թվականի ապրիլի 19-ին Արդարադատության նախարարության, մի շարք հարգված լրագրողական կազմակերպությունների և Ազգային ժողովի Գիտության, կրթության, մշակույթի, սփյուռքի երիտասարդության և սպորտի հարցերի մշտական հանձնաժողովի հետ սկսվել է համագործակցություն նաև վերոնշյալ խնդիրների օրենսդրական կարգավորման նպատակով:

Չնայած այն հանգամանքին, որ ծանր վիրավորանքի համար նախատեսված չի լինելու քրեական պատասխանատվություն՝ սա չի նշանակում, որ մադկանց արժանապատվությունը նվաստացնող հայտարարությունները մնալու են առանց իրավական լուրջ հետևանքների: Քաղաքացիական օրենսգրքով սահմանված կարգով վիրավորանքի հասցնելու պարագայում ազատ խոսքը չարաշահողները պարտավոր կլինեն վճարել փոխհատուցում մինչև 3.000.000 ՀՀ դրամի չափով:

Ուստի, մեր հայրենակիցներին ևս մեկ անգամ կոչ ենք անում զերծ մնալ վիրավորական և անպարկեշտ խոսույթից, այլապես նրանք կկրեն դրա համար օրենքով սահմանված խիստ պատասխանատվություն»,- գրել է Անդրեասյանը:
