ՀԱՊԿ-ից դուրս գալու դեպքում իշխանությունները հանրաքվե կնախաձեռնե՞ն․ Գևորգ Դանիելյանը լուրջ ռիսկեր է տեսնում

Մինչ քաղաքական տարբեր խմբեր շրջանառում են ՀԱՊԿ-ից Հայաստանի դուրս գալու հարցը, փաստենք, որ այսօրինակ գործընթացները ենթադրում են որոշակի իրավական գործընթացներ․ այսպես, ՀՀ Սահմանադրության 205-րդ հոդվածում ամրագրված է հետևյալը՝ «Վերպետական միջազգային կազմակերպություններին Հայաստանի Հանրապետության անդամակցության, ինչպես նաև Հայաստանի Հանրապետության տարածքի փոփոխությանը վերաբերող հարցերը լուծվում են հանրաքվեների միջոցով»:

Կգնա՞ն գործող իշխանությունները նման քայլի՝ հանրաքվեի, խիստ կասկածելի է, մյուս կողմից՝ քաղաքական էլիտան սկսել է պարբերաբար ակնարկել ՀԱՊԿ-ից իր չարդարացված սպասումերի մասին։

«Թեպետ վերպետական միջազգային կազմակերպություններին անդամակցության հարցի լուծումը բացառապես վերապահված է հանրաքվեին՝ դա իմպերատիվ պահանջ է, այնուամենայնիվ, համոզված եմ, որ ՀԱՊԿ-ից դուրս գալու պարագայում, ցավոք, հանրաքվե չի նախաձեռնվի։ Նախ, «Հանրաքվեի մասին» օրենքի 11-րդ հոդվածի համաձայն, ոչ միայն անդամակցելը, այլև անդամակցությունը դադարեցնելը նախատեսող միջազգային պայմանագրերի վավերացմանը առնչվող հարցով հանրաքվե անցկացնելու վերաբերյալ առաջարկությունը Կառավարությունը պետք է ներկայացնի Ազգային ժողով, իսկ վերջինս հանրաքվե անցկացնելու վերաբերյալ որոշումն ընդունում է ընդհանուր ձայների թվի մեծամասնությամբ»,-ԼՈՒՐԵՐ․com-ի հետ զրույցում նշեց իրավաբանական գիտությունների դոկտոր, պրոֆեսոր, ՀՀ արդարադատության նախկին նախարար Գևորգ Դանիելյանը։

Մեր զրուցակցի պնդմամբ, սա սոսկ Սահմանադրությամբ և օրենքով ամրագրված կարգն է, որը շրջանցելու համար, արդեն ավանդույթի ուժով, գտնվում են բազում «հիմնավոր» պատճառաբանություններ, ինչի ականատեսն ենք արդեն տևական ժամանակ։ Անգամ Ազգային ժողովի վավերացմանը ենթակա միջազգային պայմանագրերը սոսկ ստորագրվում և փաստացի ուժի մեջ են դրվում, ինչի վառ օրինակն է նոյեմբերի 9-ի՝ «Կրակի դադարեցման» հայտարարությունը, նկատեց Դանիելյանը։

«Չեմ անդրադառնում ՀԱՊԿ-ի արդյունավետության խնդրին, քանզի այլոց քննադատելուց առաջ, նախ հարկ է անաչառ լինել և ընդունել, որ անվտանգությանը և տարածքային ամբողջականությունը խաթարող փաստացի քայլերին Սահմանադրությամբ նախատեսված համարժեք արձագանք չի եղել. եթե դուք անգամ ռազմական դրություն չեք հայտարարում, ինչով փաստում եք, որ տեղի ունեցածը չեք գնահատում անգամ որպես արտաքին սպառնալիք, ապա ինչո՞ւմ եք ակնկալում, որ ձեզ աջակցեն։ Վերջապես, բացի ՀԱՊԿ-ը մենք ՌԴ-ի հետ ունենք ռազմական համագործակցության առնվազն 9 երկկողմանի միջազգային պայմանագիր, որոնք կիրառման մեջ դնելու փորձեր ևս չեն արվել»,-հավելեց իրավաբանը։
