Պետական եկամուտների կոմիտեի հետաքննության և օպերատիվ հետախուզության վարչություն տեղեկություններ էին ստացվել այն մասին, որ ՀՀ տարբեր մարզերում և Երևան քաղաքում վաճառվում են կեղծ ակցիզային դրոշմանիշերով դրոշմավորված, միաժամանակ ապրանքանիշը կեղծված ծխախոտներ։ ՊԵԿ հետաքննության և օպերատիվ հետախուզության վարչությունը, դեպքի առթիվ, ձեռնարկել է համալիր օպերատիվ-հետախուզական միջոցառումներ։

Մասնավորապես, Հետաքննության և օպերատիվ հետախուզության վարչության աշխատակիցները Երևանում, ինչպես նաև մարզերում մանրածախ առևտուր իրականացնող երեք տնտեսվարող սուբյեկտի գործունեության հասցեներում բացահայտել են ընդհանուր առմամբ 1274 տուփ առերևույթ կեղծ ակցիզային դրոշմանիշերով դրոշմավորված և ապրանքանիշը կեղծված ծխախոտների վաճառքի փաստեր։ Ձեռնարկված միջոցառումների արդյունքում պարզվել է, որ նշված տնտեսվարող սուբյեկտները կեղծ ակցիզային դրոշմանիշերով դրոշմավորված ծխախոտները ձեռք են բերել առանց համապատասխան ուղեկցող փաստաթղթերի, այդ ապրանքանիշը ներկայացնող պաշտոնական ներկայացուցչի մեծածախ գներից անհամեմատ էժան գներով և իրացնում են մանրածախ առևտրով զբաղվող տնտեսվարող սուբյեկտների մոտ առկա տվյալ ապրանքանիշի վաճառվող գներից ավելի ցածր գներով՝ վնասելով այդ ծխախոտի ապրան- քանիշը ներկայացնող անձի օրինական գործունեությունը։

Այսպիսով, վերոնշյալ անձանց գործողություններում առկա են ՀՀ քրեական օրենսգրքի 289-րդ հոդվածով սահմանված հանցակազմի հատկանիշներ, այն է՝ իրացման նպատակով կեղծ ակցիզային դրոշմանիշ կամ դրոշմապիտակ պատրաստելը, պահելը, տեղափոխելը, առաքելը, ձեռք բերելը կամ դրանք օգտագործելը կամ իրացնելը: Առերևույթ հանցագործության հատկանիշների փաստով նախապատրաստվում են նյութեր՝ քրեական վարույթ նախաձեռնելու նպատակով։

ՀՀ ՊԵԿ հետաքննության և օպերատիվ հետախուզության վարչությունը քաղաքացիներին և տնտեսվարող սուբյեկտներին հորդորում է զերծ մնալ իրացման նպատակով կեղծ ակցիզային դրոշմանիշներ կամ դրոշմապիտակներ պատրաստելուց, տեղափոխելուց և օգտագործելուց կամ դրանցով ծխախոտային ապրանքները դրոշմավորելուց, հակառակ դեպքում այդ անձինք կենթարկվեն պատասխանատվության օրենքի ողջ խստությամբ։
