 Արբիտրաժային տրիբունալը մերժել է ընդդեմ Հայաստանի Հանրապետության ներկայացված շուրջ 331 միլիոն ԱՄՆ դոլար բռնագանձելու մասին պահանջը, Լուրեր․com-ն այս մասին տեղեկանում է Միջազգային իրավական հարցերով ՀՀ ներկայացուցչի տարածած հաղորդագրությունից:

«2018 թվականի օգոստոսի 3-ին Ներդրումային վեճերի կարգավորման միջազգային կենտրոն (ICSID) մուտքագրված «Ջ. Բորկովսկին և Ռասիա ՖԶէ-ն ընդդեմ Հայաստանի Հանրապետության» թիվ ARB/18/28 արբիտրաժային գործով արբիտրաժային տրիբունալը ս.թ. հունվարի 20-ին կայացրել է վճիռ՝ ամբողջությամբ մերժելով Հայցվորների պահանջները և պարտավորեցնելով վերջիններիս Հայաստանի Հանրապետությանը փոխհատուցել ընդհանուր շուրջ 2,8 միլիոն ԱՄՆ դոլար՝ որպես կրած իրավաբանական վճարների և այլ ծախսերի հատուցում։

Երկաթուղային ճանապարհի և արագընթաց մայրուղու կառուցման առնչությամբ ծագած սույն արբիտրաժային գործը հարուցվել էր «Հայաստանի Հանրապետության և Ամերիկայի Միացյալ Նահանգների միջև ներդրումների փոխադարձաբար խրախուսման և պաշտպանության մասին» պայմանագրի, ինչպես նաև նշված ընկերության և ՀՀ կառավարության միջև 2012թ․ կնքված կոնցեսիոն պայմանագրերի հիման վրա»,- նշված է հաղորդագրության մեջ:

Արբիտրաժային գործի շրջանակներում՝ հայցվորները պնդում էին, որ Հայաստանի Հանրապետությունը խախտել է կոնցեսիոն պայմանագրերի, ինչպես նաև «Հայաստանի Հանրապետության և Ամերիկայի Միացյալ Նահանգների միջև ներդրումների փոխադարձաբար խրախուսման և պաշտպանության մասին» պայմանագրի ներքո ստանձնած մի շարք պարտավորություններ:

Հայցվորները պահանջում էին Հայաստանից բռնագանձել շուրջ 225 միլիոն ԱՄՆ դոլար, ինչպես նաև 2015 թ․ մարտի 18-ից մինչև արբիտրաժային վճռի կայացումը հաշվեգրված տոկոսները՝ շուրջ 106 միլիոն ԱՄՆ դոլար։
