Քննարկման առարկան որոշակի դեպքերում անշարժ գույքի օտարման գործարքների հարկման ավելացված արժեքի հարկով եւ շահութահարկով բազաների նվազագույն կանոնների որոշման կիրառությունն է, ավելի հստակ` կիրառության բացառությունների սահմանումը, հայտնում է ԱԺ լրատվական ծառայությունը։

Մասնավորապես, առաջարկվում է հնարավորություն ընձեռել, որպեսզի բանկերը եւ վարկային կազմակերպությունները, որոնք ունեն սեփականության իրավունքով իրենց անցած գրավի առարկաներ, դրանք օտարեն եւ ԱԱՀ-ի ու շահութահարկի գծով հարկային պարտավորությունները կատարեն օտարման փաստացի գնից ելնելով եւ ոչ թե շուկայական արժեքի մոտարկված կադաստրային արժեքի 80 տոկոսից ելնելով, որն ընդունված կանոնն է: Այս մասին ասել է Ֆինանսների նախարարի տեղակալ Արման Պողոսյանը:

Կառավարության հեղինակած «ՀՀ հարկային օրենսգրքում փոփոխություններ եւ լրացումներ կատարելու մասին» եւ «ՀՀ քաղաքացիական օրենսգրքում փոփոխություններ կատարելու մասին» օրենքների նախագծերի փաթեթը երկրորդ ընթերցմամբ քննարկվել է Տնտեսական հարցերի մշտական հանձնաժողովի` փետրվարի 2-ի արտահերթ նիստում:

Ըստ Արման Պողոսյանի` բանկերը եւ վարկային կազմակերպությունները դիմել են Կառավարությանն այն խնդրանքով, որ չեն ունեցել կանխատեսելի հարկային միջավայր, եւ 2019 թվականին գույքի գնահատման մեթոդաբանությունը սահմանող օրենքի ընդունումից հետո, երբ հաստատվել են շուկայական արժեքի մոտարկված արժեքներ, արձանագրվել է, որ դրանք երբեմն ավելի բարձր են համապատասխան գույքային միավորների օտարման կամ շուկայական գներից:

«Այս հանգամանքը գույքային միավորների գնահատումն անհատականացված ձեւով չկատարելու հետեւանք է, ինչը պահանջում է ժամանակի, ֆինանսական եւ մարդկային մեծ ռեսուրսներ: Այս խնդրի լուծումն էլ է Կառավարության ուշադրության կենտրոնում: Անցած երկու տարիներին ընդունվել են օրենքներ, որոնցով ակնկալվում է կայացնել անշարժ գույքի գնահատման ինստիտուտը»,- մանրամասնել է Ֆինանսների նախարարի տեղակալը:

Փաստելով, որ անհավասար կանոններ են գործում ռեզիդենտ եւ ոչ ռեզիդենտ կազմակերպությունների համար` Կառավարության առաջարկվող կարգավորումներով կվերացվի նաեւ այդ անհավասարությունը: Հաջորդ` տեխնիկական բնույթի փոփոխությամբ առաջարկվել է հստակեցում կատարել օրենքում, որով հայտարարագրերի ներկայացման եւ դրանց հիման վրա եկամտային հարկի վճարման վերջնաժամկետները կնույնացվեն` հարկային վարչարարությունը բարձրացնելու նկատառումով:

Հանձնաժողովի նախագահի տեղակալ Բաբկեն Թունյանը հետաքրքրվել է, թե ֆիզիկական անձանց դեպքում ինչպիսի կարգավորումներ են նախատեսվում: Արման Պողոսյանի խոսքով ֆիզիկական անձանց դեպքում առկա է ազատական ու համապարփակ կարգավորում. ֆիզիկական անձանց արժեթղթերից ստացվող եկամուտներն առհասարակ ազատված են եկամտային հարկից:

Բաբկեն Թունյանի դիտարկմամբ վերջին մեկ տարում անշարժ գույքի շուկայում տեղի են ունեցել նկատելի փոփոխություններ եւ գնային աճ:

Պատգամավորները մտահոգություն են հայտնել բանկերում գրավադրված անշարժ գույքերի կադաստրային արժեքների վերաբերյալ:

Հովիկ Աղազարյանի դիտարկմամբ բանկային հատվածին նման արտոնություն տալը տեղին չէ: Ըստ նրա` նպատակահարմար է, որ խորհրդարանը եւ Կառավարությունը պատասխանատվություն վերցնեն հնարավոր կարճ ժամանակահատվածում կադաստրային արժեքների հետ կապված որոշակի ճշգրտումներ կատարելու եւ կյանքի կոչելու գնահատման համակարգը:

Բաբկեն Թունյանի խոսքով կադաստրային մոտարկված արժեքների հարկմանը վերաբերող հարցերի լուծումն անհրաժեշտ է արագացնել: «Ճիշտը հավասարակշռված լուծում գտնելն է»,- ասել է նա:

Հանձնաժողովի փոխնախագահն առաջարկել է օրենքների նախագծերի փաթեթի քվեարկությունը հետաձգել մինչեւ երկամսյա ժամկետով` հարցերի ժամանակավոր կամ մասնակի լուծման ճիշտ տարբերակներ գտնելու նպատակով:

Գործադիրի ներկայացուցիչը, կարեւորելով փաստարկված որոշման կայացումը, ընդունել է Բաբկեն Թունյանի առաջարկը:
