ԱԱԾ-ն առաջարկում է պետական գաղտնիք պարունակող տեղեկությունների պահպանման ավելի երկար ժամկետներ սահմանել

Ազգային անվտանգության ծառայությունն առաջարկում է ավելի երկար ժամկետներ սահմանել  Պետական գաղտնիք պարունակող հատուկ կարևորության և հույժ գաղտնի տեղեկությունների պահպանության համար: Մասնավորապես՝ առաջարկվում է գործող 30 տարվա փոխարեն 40 տարի սահմանել  պետական գաղտնիք պարունակող հատուկ կարևորության տեղեկությունների պահպանման ժամկետը: Հույժ գաղտնի տեղեկությունների պահպանման ժամկետ է առաջարկվում սահմանել 30 տարի՝ գործող 10 տարվա փոխարեն:

Ազգային ժողովի Պետական-իրավական հարցերի մշտական հանձնաժողովի նիստում այս մասին ասաց Ազգային անվտանգության ծառայության տնօրենի տեղակալ, գեներալ-մայոր Տիգրան Հարությունյանը՝ ներկայացնելով Պետական գաղտնիքի մասին օրենքի և հարակից օրենքների նախագծերի փաթեթը։

Գործող օրենքով պետական գաղտնիք պարունակող հատուկ կարևորության տեղեկությունների պահպանման ժամկետ է սահմանված մինչև 30 տարի, իսկ հույժ գաղտնի տեղեկությունների պահպանման ժամկետ՝ 10 տարի:

«Ներկայացված օրենքների նախագծերով առաջարկվում է լուծել տարիների ընթացքում ոլորտում առաջացած իրավական խնդիրները, վերացնել օրենսդրական բացերը, առավել հստակ կարգավորումներ նախատեսել պետական գաղտնիք կազմող տեղեկությունների շրջանառության համար։ Միաժամանակ, կվերանայվեն պետական գաղտնիք պարունակող տեղեկությունները հրապարակելու համար օրենքով նախատեսված պատասխանատվության միջոցները»,- ասաց Հարությունյանը։

ԱԱԾ տնօրենի տեղակալի խոսքով՝ Ազգային ժողովի կողմից առաջին ընթերցմամբ ընդունելուց հետո նախագծերի վերաբերյալ գրավոր առաջարկներ չեն եղել, սակայն նախագծերի փաթեթը լրամշակվել է Պետական-իրավական հարցերի մշտական հանձնաժողովի նիստում, ինչպես նաև հանձնաժողովի կողմից կազմակերպած աշխատանքային քննարկումների ընթացքում։

«Մասնավորապես, պետական գաղտնիքի մասին օրենքի նախագծում խմբագրվել են պետական գաղտնիքի և պետական գաղտնիք պարունակող տեղեկությունների հասկացությունները։ Հստակեցվել է սահմանափակ տարածման ծառայողական տեղեկության հասկացությունը։ Նախագիծը լրացրել է գաղտնագրման համաչափության սկզբունքով՝միաժամանակ սահմանելով այդ սկզբունքի բովանդակությունը։ Վերանայվել են իրավունքների ժամանակավոր սահմանափակումների վերաբերյալ դրույթները՝ նախատեսելով ավելի մեղմ կարգավորումներ։ Պետական գաղտնիք պարունակող հատուկ կարևորության և հույժ գաղտնի տեղեկությունների պահպանության համար սահմանվել են առավել երկար՝ համապատասխանաբար 40 և 30 տարի պահպանման ժամկետներ։

Հստակեցվել են պետական գաղտնիք պարունակող տեղեկություններին ծանոթանալու վերաբերյալ դրույթները, նոր խմբագրությամբ են շարադրվել եզրափակիչ մասն ու անցումային դրույթները՝ առավել հստակ ամրագրելով օրենքի առանձին կարգավորումների ուժի մեջ մտնելու ժամանակահատվածները»,- տեղեկացրեց Հարությունյանը։

ԱԱԾ տնօրենի տեղակալը նաև հավելեց, որ  նախագծում կատարվել են մի շարք  խմբագրական բնույթի փոփոխություններ։
