Ի կատարումն ՀՀ գլխավոր դատախազի հանձնարարության՝ Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջանների դատախազությունում քննության առարկա են դարձել համայնքին սեփականության իրավունքով փոխանցված մանկապարտեզների օտարման գործընթացները:

Դատախազությունից հայտնում են, որ նկատի ունենալով, որ համայնքին սեփականության իրավունքով փոխանցված ուսումնական հաստատությունը (նախակրթական հաստատությունը) օտարվելու դեպքում չի կարող օգտագործվել այլ նպատակներով (քրեական վարույթների ուսումնասիրությամբ պարզվել է, որ մի շարք մանկապարտեզներ օտարվել են որպես ոչ բնակելի տարածքներ, իսկ որոշ դեպքերում՝ ներառվել բնակելի ֆոնդում)՝ Երևան քաղաքի Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջանների դատախազությունը 2023 թվականի հունիսի 5-ին Վարչական դատարան է ներկայացրել 5 հայց՝ Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջաններում գործած մանկապարտեզների տարածքներն օտարելու վերաբերյալ համայնքի ավագանու և համայնքի ղեկավարի համապատասխան որոշումներն անվավեր ճանաչելու պահանջի մասին:

Մասնավորապես՝ Դատախազությունը Վարչական դատարանում վիճարկում է.

  1. Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի Դ.Անհաղթ փողոցի 5 հասցեում գտնվող 141.5 քմ մակերեսով շինության օտարումը (նախկին 147 մսուր-մանկապարտեզ), իսկ որպես հետևանք՝ վերոնշյալ տարածքի նկատմամբ «N» ՍՊ ընկերության սեփականության իրավունքի գրանցումը:
  2. Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի Դրոյի փողոց 21 ա շենքի 1-ին հարկում գտնվող 126.9 քմ մակերեսով շինության օտարումը (նախկին 199 մսուր-մանկապարտեզ), իսկ որպես հետևանք՝ վերոնշյալ տարածքի նկատմամբ Ա.Ջ.-ի սեփականության իրավունքի գրանցումը:
  3. Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի Հր.Ներսիսյան փողոցի 1 շենքում գտնվող 121.2 քմ մակերեսով շինության օտարումը (նախկին թիվ 132 մանկապարտեզ), իսկ որպես հետևանք՝ վերոնշյալ տարածքի նկատմամբ Ա.Գ.-ի, Ն.Ս.-ի և Ա.Հ.-ի սեփականության իրավունքի գրանցումը:
  4. Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի Հր.Ներսիսյան փողոցի թիվ 1 շենքում գտնվող 83.9 քմ մակերեսով շինության օտարումը (նախկին թիվ 132 մանկապարտեզ), իսկ որպես հետևանք՝ վերոնշյալ տարածքի նկատմամբ Է.Վ.-ի սեփականության իրավունքի գրանցումը:
  5. Երևան քաղաքի Քանաքեռ-Զեյթուն համայնքի Զ.Քանաքեռցու փողոցի թիվ 32 հասցեում գտնվող 2575,5 քմ մակերեսով շինության օտարումը (նախկին 159 մանկապարտեզ), իսկ որպես հետևանք՝ վերոնշյալ տարածքի նկատմամբ Ս.Ս.-ի և Ա.Ե.-ի սեփականության իրավունքի գրանցումը:

Վարչական շրջանների դատախազությունը հայցեր է ներկայացրել նաև քրեական երկու վարույթի նյութերով:

Մասնավորապես՝ Դատախազությունը Վարչական դատարանում վիճարկում է.

Երևան քաղաքի Դավիթ Անհաղթ փողոց 8 հասցեում գտնվող, 23153,65 քմ մակերեսով տարածքը «Երևանի տեխնոլոգիական սարքավորումների գործարան» ԲԲ ընկերության սեփականության իրավունքի պետական գրանցումն անվավեր ճանաչելու վերաբերյալ որոշումը:

Երևան քաղաքի Զ.Քանաքեռցու փողոցի 50 հասցեում գտնվող 2370 քմ մակերեսով տարածքը «Խաչարամ կոնսերվատորիա» ՍՊԸ-ին օտարելու վերաբերյալ որոշումը:
