Օրենսդրական փաթեթով կկարգավորվեն վարչական դատավարության ընթացքում ծագած մի շարք ընթացակարգային խնդիրներ

Գործադիրը փոփոխություններ եւ լրացումներ է առաջարկում Վարչական դատավարության ու Վարչական իրավախախտումների վերաբերյալ օրենսգրքերում: Հիմնական կարգավորումներն ԱԺ պետական-իրավական հարցերի մշտական հանձնաժողովի նիստում առաջին ընթերցմամբ ներկայացրել է ՀՀ արդարադատության նախարարի տեղակալ Արա Մկրտչյանը:

Կարգավորվում են հիմնական պահանջից բացի, այլ ածանցյալ պահանջներ ներկայացնելու դեպքում պետտուրքի գանձման հարցրերը: Նախատեսվում են արագացված դատաքննության կարգի եւ ժամկետների ավելի մանրամասն կանոններ՝ սահմանելով, թե որ պահից է դատարանն անցնում դատական ակտ կայացնելուն եւ երբ պետք է հրապարակվի դատական ակտը: Լրացվող նոր հոդվածներով կկարգավորեն Վերաքննիչ եւ Վճռաբեկ դատարանների որոշումների մեջ առկա վրիպակների, գրասխալների, թվաբանական սխալների ուղղման պահանջները: Եթե անձը հարգելի պատճառով բաց թողնված ժամկետում Վճռաբեկ դատարան բողոք է ներկայացնում, սակայն չի միջնորդում ժամկետը վերականգնելու մասին, ապա ներկայումս Վճռաբեկ դատարանը բողոքի ընդունումը մերժում է, եւ անձի իրավունքը մնում է չիրացված: Առաջարկվում է այս դեպքում ոչ թե մերժել բողոքի ընդունումը, այլ վերադարձնել բողոքը:

Վերաքննիչ դատարանի կողմից գործի քննությունն ավարտելուց հետո որոշման հրապարակման համար սահմանվում է 20-օրյա ժամկետ: Հստակ սահմանվում է, թե ինչ որոշում պետք է կայացնի Վճռաբեկ դատարանն այն դեպքում, երբ բողոք բերող անձը չի վերացրել Վճռաբեկ բողոքը վերադարձնելու մասին որոշման մեջ նշված թերությունները կամ բողոքը կրկին ներկայացնելու դեպքում թույլ են տրվել նոր խախտումներ:

Սահմանվում են հստակ ժամկետներ միջանկյալ դատական ակտերի դեմ բերված վճռաբեկ բողոքները քննելու համար, այն է՝ վարույթ ընդունելուց հետո 45 օրվա ընթացքում: Առաջարկվում է միջուկային անվտանգության ապահովման, հարկադիր կատարումն ապահովող, պրոբացիայի ծառայության բնագավառների պետական մարմնին տեղեկատվություն չտրամադրելու վերաբերյալ գործերով քննությունը դատարանից հանել եւ վերապահել իրավասու վարչական մարմիններին:

Օրենսդրական փաթեթը ստացել է հանձնաժողովի դրական եզրակացությունը:
