Դատապարտում ենք Ադրբեջանի կողմից ԼՂ-ում կատարված քաղաքական նշանակումները

Ցանկացած քաղաքական նշանակում օկուպացված Լեռնային Ղարաբաղի ցանկացած քաղաքում կամ տարածաշրջանում, հատկապես էթնիկ զտումների և ցեղասպանության սպառնալիքի ներքո իրենց տներից բռնի կերպով վտարված բնակչության բացակայության դեպքում, և՛ անօրինական է, և՛ դատապարտելի: Այս մասին հայտարարություն է տարածել Լեռնային Ղարաբաղի ժողովրդի հիմնարար իրավունքների պաշտպանության հանձնախումբը: 

Ի լրումն, մենք դատապարտում ենք Ադրբեջանի կողմից Լեռնային Ղարաբաղում կատարված այլ քաղաքական նշանակումները, որոնք էլ ավելի են ընդգծում Լեռնային Ղարաբաղի բնիկ ժողովրդի ժողովրդավարական կամքի և իրավունքների համակարգված անտեսումը:

Ադրբեջանի այս գործողությունները ոչ միայն հակասում են ինքնորոշման և ժողովրդավարական կառավարման սկզբունքներին, այլև հստակորեն ցույց են տալիս տարածաշրջանի քաղաքական և վարչական գործընթացներում Լեռնային Ղարաբաղի ժողովրդի կամքն արտացոլելու իրական ջանքերի բացակայությունը:

Մենք նաև խորապես հիասթափված ենք Կարմիր Խաչի միջազգային կոմիտեի առաքելության դուրսբերմամբ Լեռնային Ղարաբաղից։ Առանց ԿԽՄԿ-ի՝ տեղում միակ միջազգային ներկայության, Ադրբեջանի ձեռքերը լիովին ազատ կլինեն անելու այն, ինչ կցանկանա․ ինչին էլ նա ձգտում էր երկար ժամանակ։

Թեև Լեռնային Ղարաբաղում ստեղծված իրավիճակը չի նպաստում տեղահանվածների անվտանգ վերադարձին, միջազգային իրավունքը պաշտպանում է բռնի տեղահանված անձանց իրենց ծագման տարածք վերադառնալու իրավունքը: Այս իրավունքը ճանաչված է որպես միջազգային իրավունքի, մարդու իրավունքների և միջազգային մարդասիրական իրավունքի սովորութային նորմ, և այն պաշտպանված է Մարդու իրավունքների համընդհանուր հռչակագրով, Քաղաքացիական և քաղաքական իրավունքների միջազգային կոնվենցիայով և բազմաթիվ այլ միջազգային կոնվենցիաներով ու հռչակագրերով:

Անցյալ տարվա նոյեմբերի 17-ին Արդարադատության միջազգային դատարանը վճռեց, որ Ադրբեջանը պետք է «ապահովի», որ Լեռնային Ղարաբաղի հայերը կարողանան «անվտանգ, անարգել և արագ» վերադառնալ: Ս․թ․ մարտի 12-ին Եվրախորհրդարանը բանաձեւ ընդունեց, որով կոչ էր անում Ադրբեջանին «իրական համապարփակ և թափանցիկ երկխոսության մեջ մտնել Ղարաբաղի հայերի հետ՝ ապահովելու նրանց իրավունքների հանդեպ հարգանքը և երաշխավորելու նրանց անվտանգությունը, ներառյալ՝ նարանց վերադարձի և իրենց տներում ապրելու իրավունքը՝ արժանապատիվ և անվտանգ կերպով՝ միջազգային ներկայության պայմաններում»:

Մենք կոչ ենք անում Ադրբեջանին պատերազմի և բռնության հետևանքով ձեռք բերված տարածքների ապօրինի ձևակերպմամբ զբաղվելու փոխարեն կատարել իր միջազգային պարտավորությունները ՝ ապահովելով Լեռնային Ղարաբաղի ժողովրդի անվտանգ և անարգել վերադարձը իրենց տներ և պատմական հայրենիք»:
