«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2009 թ. ապրիլի 2-ի N 351-Ն որոշման մեջ: Պայմանավորված 2021 թ. հունիսի 30-ին ընդունված Քրեական դատավարության օրենսգրքի նոր իրավակարգավորումներով, անհրաժեշտություն է առաջացել ոստիկանության կողմից ձերբակալված և կալանավորված անձանց ուղեկցումը և պահպանման իրականացման ընթացակարգը համապատասխանեցնել գործող քրեադատավարական կարգավորումներին:

Ուղեկցող ստորաբաժանումների ծառայողների պարտականությունները սահմանված են թիվ 351-Ն որոշման 3-րդ գլխում, որի 3031-րդ կետերում ուղեկցվող անձանց անձնական խուզարկության ենթարկելու մասով նշված է, որ այն կատարվում է օրենսդրությամբ սահմանված դեպքերում և կարգով: Ուղեկցվող, ձերբակալված կամ կալանավորված անձանց անձնական խուզարկությունն իրականացվում է ՁՊՎ-ներ և քրեակատարողական հիմնարկներ արգելված իրերի, առարկաների և սննդամթերքի ներթափանցումը, ինչպես նաև այդ իրերն ուղեկցման ընթացքում փախուստի կամ ինքնավնասում կատարելուն և այլ հանցավոր մտադրություններին ծառայեցնելը բացառելու նպատակով:

Գործնականում անձնական խուզարկությունն իրականացվում է ուղեկցողների և ՁՊՎ /ՔԿՀ ծառայողների կողմից համատեղ: Նույն որոշման, ինչպես նաև կառավարության 2008 թ.-ի հունիսի 5-ի «ՀՀ ոստիկանության համակարգում գործող ձերբակալվածներին պահելու վայրերի ներքին կանոնակարգը հաստատելու մասին» թիվ 574-Ն և կառավարության 2023 թ.-ի ապրիլի 13-ի «ՀՀ արդարադատության նախարարության քրեակատարողական ծառայության՝ կալանավորվածներին պահելու վայրերի և ուղղիչ հիմնարկների ներքին կանոնակարգը հաստատելու մասին» N 543-Ն որոշումների ուսումնասիրությունը ցույց է տալիս, որ նրանցում ներառված չէ ինչպես ուղեկցվող, այնպես էլ ՁՊՎ-ում և ՔԿՀ-ում պահվող ձերբակալված և կալանավորված անձանց համապատասխան ծառայողների կողմից անձնական խուզարկության ենթարկելու քրեագիտական մարտավարությունը (տակտիկան):

Անձնական խուզարկությունը համապատասխան ծառայողների կողմից իրականացվում է ձևավորված պրակտիկայի ուժով, և նշված հարցի իրավական կարգավորման բացակայությունը կարող է հանգեցնել ձերբակալված և կալանավորված անձանց անձևական իրավունքների ոտնահարմանը, ինչպես նաև՝ մասնագիտացված ուղեկցող ստորաբաժանումների ծառայողների կողմից իրենց պարտականությունների ոչ պատշաճ կատարմանը, որն էլ, իր հերթին, կարող է ձերբակալված կամ կալանավորված անձանց կողմից փախուստի, ինքնասպանության, ինքնավնասման, պահակախմբի և ուղեկցողի վրա հարձակման փորձերի պատճառ դառնալ:

Նշվում է, որ անհրաժեշտ է գործող որոշման մեջ առկա մի շարք ձևակերպումներ համապատասխանեցնել Քրեական դատավարության օրենսգրքով սահմանված նոր իրավակարգավորումներին և «Ոստիկանության մասին» օրենքի 17-րդ հոդված 1-ին մասի 1-ին կետի գ. ենթակետին:
