«Վերջին տասնամյակների ընթացքում համաշխարհային պրակտիկայում հստակ միտում է նկատվում հարկային և տնտեսական հանցագործությունների ապաքրեականացման ուղղությամբ: Այս ռազմավարության հիմնական նպատակը այնպիսի իրավական դաշտ ստեղծելն է, որը կաջակցի երկրի տնտեսական կյանքի հիմնական դերակատարների՝ ձեռնարկատերերի և կորպորատիվ կազմակերպությունների բնականոն գործունեությանը: 

Հարկային և տնտեսական իրավախախտումների ապաքրեականացումը (քրեականացման մակարդակի նվազեցումը), այլ հավասար պայմաններում (այսինքն՝ երբ բիզնեսի զարգացման համար մյուս անհրաժեշտ պայմանները՝ ներառյալ ներքին ու արտաքին անվտանգության հիմնախնդրի կարգավորումը, բավարարված են) նպաստում է բարենպաստ բիզնես միջավայրի ձևավորմանը, խթանում է տնտեսական ակտիվությունը և ներգրավում ներդրումներ։

Տնտեսական կայունությունն ու աճը մեծապես կախված են բիզնեսի վստահությունից իրավական համակարգի անաչառության և արդարության նկատմամբ: Հետևաբար, պետության կարևորագույն խնդիրներից է հարկային կարգավորման այնպիսի կանոնների սահմանումը, որոնք թույլ կտան արդյունավետ կերպով հավաքագրել հարկերը՝ առանց ձեռնարկատիրական գործունեության համար ավելորդ խոչընդոտներ ստեղծելու։ Սա է պատճառը, որ շատ երկրներ ձգտում են նվազեցնել իրավապահ մարմինների ներազդեցության մակարդակը բիզնեսի վրա՝ քրեական պատժամիջոցները փոխարինելով վարչական և ֆինանսական միջոցներով:

Հատկանշական է, որ միջազգային միտումներին համահունչ մոտեցում, ոչ վաղ անցյալում, որդեգրել էր նաև մեր երկրի իրավահամակարգը, ինչը հստակ ներկայացվում էր որպես ռազմավարական ազդարարում՝ համաշխարհային տնտեսական գործընթացներին ինտեգրվելու և հարկային վարչարարության ոլորտում միջազգային չափանիշներին համապատասխանելու ցանկության մասին։

Սակայն տագնապալի է, որ հարկային գործընթացների իրավական կարգավորումը հաճախ ենթարկվում է քաղաքական պայմանների ազդեցությանը։ Նման պայմաններում կարող են առաջանալ իրավիճակներ, երբ որոշումները կայացվում են ոչ թե օբյեկտիվ տնտեսական ցուցանիշների և իրավական նորմերի հիման վրա, այլ ներկայիս քաղաքական նկատառումներին համապատասխան։ Նման նախաձեռնությունները (օրինակ՝ ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 5-րդ մասը վերացնելու օրենսդրական նախաձեռնությունը) կարող են հանգեցնել օրենսդրության ոչ համակարգված փոփոխություններ կատարելու վարքագծի ամրապնդմանը՝ ստեղծելով անորոշություններ ու խոչընդոտներ բիզնեսի համար, ինչն իր հերթին, ակնհայտորեն բացասաբար է անդրադառնալու տնտեսական կայունության և իրավական համակարգի նկատմամբ ձեռնարկատերերի վստահության վրա։

Կայուն տնտեսական աճի հասնելու և երկարաժամկետ զարգացում ապահովելու համար անհրաժեշտ է ձգտել նվազագույնի հասցնել քաղաքական ազդեցությունը հարկային կարգավորման գործընթացների վրա։ Կարևոր է, որ հարկային բարեփոխումներն ուղղված լինեն հարկային համակարգի թափանցիկության, կանխատեսելիության և արդարության բարձրացմանը, ինչպես նաև բարենպաստ բիզնես միջավայրի ստեղծմանը, որը խթանում է տնտեսական ակտիվությունը և ներգրավում ներդրումներ։

Այսպիսով, հարկային և տնտեսական հանցագործությունների ապաքրեականացումը, որպես ավելի լայն տնտեսական բարեփոխումներ իրականացնելու պատրաստակամության դրսևորման անվիճելի երաշխիք, պետք է ուղղված լինի բիզնեսի և պետության միջև վստահության ամրապնդմանը, որն ընդհանուր առմամբ տնտեսության հավասարակշռված և կայուն զարգացման բանալին է»:
