Երեկվա քննարկման ժամանակ տեղեկացա, որ գործադիր իշխանությունը (իրավապահ համակարգը), ձերբակալման առկա կարգավորումները շրջանցելու նպատակով, պլանավորում է Օրենքում նախատեսել ձերբակալման բազմաթիվ տեսակների մեջ ևս մեկը՝ «ապացույցների հիման վրա ձերբակալում»։ Այդ մասին ֆեյսբուքյան իր էջում գրել է փաստաբան Արթուր Ղամբարյանը․

«Սրան զուգահեռ, Օրենսդիրը հրաժարվել է արժեքավոր նորմից, ըստ որի՝ ձերբակալված անձին ազատ արձակելուց հետո, եթե նրան մեղադրանք չի ներկայացվում, ապա նա համարվում է արդարացված և պաշտպանվում է կրկին դատվելու անթույլատրելիության սկզբունքով։

Եթե «ապացույցների հիման վրա ձերբակալում» նախագիծն ընդունվի, ապա քաղաքական իշխանությունը հնարավորություն կստանա, մարդկանց վարքագիծը վերահսկելու նպատակով, քրեական վարույթի հետ առնչվող ցանկացածին անխոչընդոտ ձերբակալել, մի քանի օր անց՝ ձերբակալվածին ազատ արձակել և մեղադրանք չներկայացնել՝ նրան անորոշ ժամկետով պահելով անորոշ կարգավիճակի մեջ․ նա այլևս չի համարվում արդարացված, ուստի ոչ ցանկալի վարքագծի դեպքում նրան՝ ցածր շեմի կասկածանքով մեղադրանք կներկայացվի և «նեոմացոյական» համակարգը նրան կկալանավորվի։

Այս ամենին զուգահեռ, խուլիգանության հանցակազմն այնքան լայն է մեկնաբանվում, որ օրինակ՝ դուռը ուժեղ ծեծելը, ամոթը կորցրած «Հրեշը», համարում է խուլիգանություն և դրա համար մարդ ձերբակալում (օրինակ՝ Դավիթ Սարգսյանի գործը)։

Այս փոփոխությունը ունի մեկ նպատակ՝ քրեական դատավարությունը պետական իշխանության ինքնասահմանափակման միջոցից կրկին վերածել հասարակությունը վերահսկելու ինկվիզիցիոն միջոցի։

Սա պետք է կանխել։
Նախ՝ հուսով եմ ՀՀ ազգային ժողովում կլինեն իրավունքի սկզբունքներով մտածող իրավաբաններ, ովքեր այդ նախագիծը կդարձնեն համակողմանի քննարկման առարկա և չեն խաբնվի իրավապահների՝ առաջին հայացքից ճշմարտանման, բայց հակաիրավական «փաստարկներով»։

Երկրորդ՝ մարդու իրավունքների պաշտպանությամբ զբաղվող ինստիտուտները, այդ թվում՝ փաստաբանները պետք է նախաձեռնեն ռազմավարական դատավարություններ՝ վիճարկելու օրենսդրի լռության սահմանադրականությունը՝ այնքանով, որ նա չի նախատեսել նորմ (ավելի ճիշտ՝ հրաժարվել է այն նորմից), ըստ որի՝ ձերբակալված, այնուհետև՝ ազատ արձակված անձին մեղադրանք չներկայացնելու դեպքում նա իրավունքի ուժով ձեռք է բերում արդարացվածի կարգավիճակ»,- գրել է Ղամբարյանը։
