ՀՀ կառավարության վերջին նիստում գործադիրը հավանության է արժանացրել «Թանգարանների մասին» օրենքի նախագծի վերաբերյալ օրենսդրական նախաձեռնությունը, որը սահմանված կարգով ներկայացվել է Ազգային ժողով:

ԿԳՄՍՆ-ից հայտնում են, որ համաձայն հիմնավորման՝ վերջին տարիներին նյութական և ոչ նյութական մշակութային ժառանգության վերաբերյալ ընդունվել են մի շարք ՀՀ օրենքներ («Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին», «Մշակութային արժեքների արտահանման և ներմուծման մասին», «Արխիվային գործի մասին», «Ոչ նյութական մշակութային ժառանգության մասին», «Գրադարանների և գրադարանային գործի մասին»), որոնք կարգավորում են մշակութային ժառանգության բնագավառները: Անհրաժեշտություն է առաջացել նաև կարգավորել թանգարանների ոլորտը. մասնավորապես՝ հստակեցված չեն մշակութային ժառանգության անբաժանելի մաս կազմող ՀՀ թանգարանային հավաքածուի, ինչպես նաև յուրաքանչյուր թանգարանի հավաքածուի օգտագործման, տնօրինման, թանգարանների ստեղծման (անկախ սեփականության ձևից) խնդիրները:

Օրենքի նախագիծը մշակելու նպատակով նախարարության կողմից ուսումնասիրվել է թանգարանային գործի զարգացվածության մակարդակով աչքի ընկնող մի շարք երկրների (Կանադա, ԱՄՆ, Միացյալ Թագավորություն, Ֆրանսիա, Գերմանիա, Լատվիա, Ճապոնիա), ինչպես նաև ԱՊՀ երկրների թանգարանային  գործը կարգավորող օրենսդրությունը: Օրենքում կիրառվել է ՅՈՒՆԵՍԿՕ-ի շրջանակում Թանգարանային միջազգային խորհրդի կողմից ընդունված Թանգարանների աշխատողների մասնագիտական վարքագծի կանոնագիրքը, ինչը եվրոպական պետությունների` Գերմանիայի Դաշնության, Լյուքսեմբուրգի, Իտալիայի թանգարանների ղեկավարման համար ճանաչվել է իրավական փաստաթուղթ: Եվրոպական Միության ԹԱՅԵՔՍ տեխնիկական օժանդակության և տեղեկատվության փոխանակման գործիքի շրջանակում նախագիծը քննարկվել է նաև փորձագիտական առաքելության կողմից։

Օրենքի նախագծում կարգավորվել են ոչ միայն պետական թանգարանային հավաքածուի, այլև ոչ պետական թանգարաններին առնչվող հարաբերությունները: Հստակեցվել են պետական uեփականություն չհանդիսացող մշակութային արժեքները ՀՀ պետական թանգարաններում ժամանակավոր պահպանության հանձնելու, թանգարանի ֆոնդերը թանգարանային առարկաներով համալրելու, հաշվառելու, հանրայնացնելու սկզբունքները, թանգարանների և հավաքածուների սեփականատերերին պետական աջակցության ձևերը, ինչպես նաև թանգարանների հավատարմագրման և  կարգավիճակ ստանալու ընթացակարգը:

Այսպիսով՝ օրենքի ընդունմամբ կապահովվի մշակութային ժառանգության պահպանության և պաշտպանության համակարգված գործունեությունը, մշակույթի ոլորտում տնտեսական նոր մեխանիզմների և շուկայական հարաբերությունների զարգացումը, ինչպես նաև իրավաբանական և ֆիզիկական անձանց միջև ծագող հարաբերությունների կարգավորումը մշակույթի բնագավառում:
