Գլխավոր դատախազության պետական շահերի պաշտպանության վարչության հայցադիմումը 2024 թվականի փետրվարի 9-ին Հակակոռուպցիոն դատարանի վճռով բավարարվել է. Հայաստանի Հանրապետությանն է վերադարձվել Կոտայքի մարզի Աղավնաձոր բնակավայրին հարող՝ ընդհանուր 1 հա մակերեսով հողամասը:

Գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունը դատարանից պահանջել էր անվավեր ճանաչել Կոտայքի մարզի Աղավնաձոր բնակավայրին հարող` ընդհանուր 1 հա հողամասի նկատմամբ կայացած աճուրդները և կիրառել անվավերության հետևանք:

Հիշեցնենք՝ քրեական վարույթով պարզվել էր, որ Կոտայքի մարզպետի՝ 2007 թվականի ապրիլի 23-ի որոշմամբ, համայնքների վարչական սահմաններից դուրս՝ մարզի տարածքում գտնվող, պետական սեփականություն հանդիսացող հատուկ պահպանվող տարածքներից 48.57 հա հողամասը ներկայացվել էր օտարման՝ աճուրդի եղանակով: Վերոնշյալ որոշման հիման վրա` 2007 թվականի մայիսի 26-ին կայացած աճուրդում քաղաքացի Ա. Խաչատրյանին էր օտարվել երկու հողամաս՝ յուրաքանչյուրը 0,5 հա մակերեսով՝ ընդհանուր 2 մլն 430 հազար դրամով:

Քրեական վարույթի շրջանակում հաստատվել էր, որ աճուրդները փաստացի չեն կայացել, կրել են ձևական բնույթ, խախտվել են «Հրապարակային սակարկությունների մասին» օրենքի և «Պետական սեփականություն հանդիսացող հողամասերն օտարելու և օգտագործման տրամադրելու կարգը հաստատելու մասին» Կառավարության 2001 թվականի ապրիլի 12-ի որոշման պահանջները. առանց փաստացի աճուրդներ կազմակերպելու, անցկացնելու՝ վերոնշյալ հողամասերն իրացնելու վերաբերյալ կազմվել էին իրականությանը չհամապատասխանող փաստաթղթեր այն մասին, որ աճուրդները կայացել են և կոնկրետ անձինք հաղթող են ճանաչվել: Նշված անձանց հետ կնքվել էին հողամասի առուվաճառքի պայմանագրեր, որոնց համաձայն՝ կատարվել էր անշարժ գույքի պետական գրանցում:

Հակակոռուպցիոն դատարանի՝ 2024 թվականի փետրվարի 9-ի վճռով՝ անվավեր են ճանաչվել Կոտայքի մարզպետարանի կողմից 2007 թվականի մայիսի 26-ին իրականացված երկու աճուրդները. որպես հետևանք՝ անվավեր են ճանաչվել Կոտայքի մարզպետի և քաղաքացի Ա. Խաչատրյանի միջև 2007 թվականի մայիսի 31-ին կնքված առուվաճառքի պայմանագրերը և Անշարժ գույքի կադաստրի պետական կոմիտեի կողմից կատարված՝ սեփականության իրավունքի պետական գրանցումները:

Կոտայքի մարզի Աղավնաձոր բնակավայրին հարող՝ ընդհանուր 1 հա մակերեսով երկու հողամասերի նկատմամբ վերականգնվել է (ճանաչվել է) Հայաստանի Հանրապետության սեփականության իրավունքը:

Վճիռն ուժի մեջ է մտել 2024 թվականի մարտի 12-ին:
