Դավիթ Տոնոյանի փաստաբանական խումբը հայտարարություն է տարածել, որում ասվում է․

«Հայտնում ենք, որ Դավիթ Տոնոյանի և մյուս անձանց վերաբերյալ քննվող քրեական գործով 04.02.2022թ.  նշանակված առաջին իսկ դատական նիստը չի կայացել և անորոշ ժամկետով հետաձգվել է ազատության մեջ գտնվող դատավարության մասնակիցների, ինչպես նաև նախագահող դատավորի վատառողջության պատճառով:

Միաժամանակ հայտնում ենք, որ Դավիթ Տոնոյանը շարունակում է պնդել և պահանջել բաց և հրապարակային դատավարություն, որը դռնփակ ռեժիմով է անցկացվում  դատավոր Մանվել Շահվերդյանի անհիմն որոշմամբ՝ մասնագիտական առումով պետական և ռազմական գաղտնիք հասկացություններին առհասարակ չտիրապետելու պատճառով: Հաստատապես շարունակում ենք պնդել, որ քրեական գործի նյութերում չկան պետական և ռազմական գաղտնիք պարունակող տեղեկություններ, որոնք կրում են «հույժ գաղտնի» դրոշմը, իսկ հետազոտվելիք նյութերը առավելապես ծառայողական գաղտնիք պարունակող նյութեր են: Դատավորն իր որոշումը կայացնելուց առաջ որևէ միջոց  անգամ չի գործադրել համապատասխան գերատեսչությունից պարզելու՝ քրեական գործում առկա է արդյո՞ք օրենքով պահպանվող գաղտնիք, թե ոչ, իսկ այդ նյութերի մեծ մասը որպես ծառայողական գաղտնիք դասելու նախաձեռնող-հեղինակը եղել է հենց Դավիթ Տոնոյանը:

Հայտնում ենք նաև, որ մինչ օրս վերաքննիչ քրեական դատարանում մեր կողմից Դավիթ Տոնոյանին շարունակական կալանքի տակ պահելու մասին որոշման դեմ ներկայացված բողոքը որևէ դատավորի չի մակագրվել, բողոքի քննության օր նշանակված չէ, որը հայտնի լինելուն պես լրացուցիչ կտեղեկացնենք»:
