Դատարանը բավարարել է «Հայ փոքրիկ երգիչներ»-ի փաստաբանի բողոքը

Ինչպես տեղյակ եք, Արամի 23 հուշարձան-շենքի հարևանությամբ 2018թ. շվեյցարահայ գործարար Վարդան Սրմաքեշի «Օլդ սիթի» ՍՊ ընկերության իրականացրած ապօրինի շինարարության հետևանքով մասնակի փլուզվել է «Հայ փոքրիկ երգիչներ» մանկական երգչախմբին պատկանող հուշարձան շենքը։

Այս կապակցությամբ ՀՀ գլխավոր դատախազությունը հարուցել է քրեական գործ, որի հիմնական քննությունը վարում է քննիչ Խաչատուր Գալստյանը։

Վերջինս մոտ 5 տարի գործն անհարկի ձգձգելուց հետո հիմնական մեղադրյալների ցանկից ապօրինաբար հանեց շվեյցարահայ գործարար Վարդան Սրմաքեշի «Օլդ սիթի» ՍՊ ընկերության տնօրեն Գևորգ Մաչանյանին, 2 անձի մասով քրեական գործն ուղարկեց դատարան, ապա մնացած մասով անհիմն կերպով կարճեց քրեական գործը։

Ընդ որում, ՀՀ գլխավոր դատախազ Աննա Վարդապետյանին ուղղված բոլոր բողոքները և դիմումները մնացին անհետևանք։

«Հայ փոքրիկ երգիչներ» միջազգային ընկերակցության փաստաբան Արթուր Մանուկյանը քրեական գործը վերաբացելու և Գևորգ Մաչանյանին մեղադրյալների ցանկում ներգրավելու հայցով դիմեց դատարան: Երևան քաղաքի ընդհանուր իրավասության դատարանի դատավորներ Դավիթ Բալայանը և Նելլի Բաղդասարյանը կայացրին օբյեկտիվ և արդարամիտ որոշումներ՝ Գևորգ Մաչանյանի և ընդհանուր քրեական գործի կարճման որոշումները վերացնելու մասին, իսկ դրանց դեմ դատախազության և Գևորգ Մաչանյանի պաշտպանի ներկայացրած վերաքննիչ բողոքները դատավորներ Վազգեն Ռշտունին և Լուսինե Հովհաննիսյանը արդարացիորեն մերժեցին և գործն ուղարկեցին նորից քննության:

Դրանից հետո քննիչը կատարեց ակնհայտորեն ձևական նախաքննություն, և դատախազի հետ դարձյալ անհիմն կերպով քրեական գործը կարճեցին և կրկին անհիմն կերպով վերացրին Գևորգ Մաչանյանի մեղադրանքը։ ՀՓԵ-ի փաստաբանը այս որոշումը դարձյալ բողոքարկեց դատարանում, նիստը նշանակվեց հունվարի 26-ին։

Եվ ահա այսօր դատարանը՝ դատավոր Հովհաննես Ավագյանի գլխավորությամբ, օբյեկտիվ և արդարացի կերպով բավարարեց «Հայ փոքրիկ երգիչներ»-ի փաստաբան Արթուր Մանուկյանի բողոքը և նորից գործում որպես մեղադրյալ ներգրավվեց շվեյցարահայ գործարար Վարդան Սրմաքեշի «Օլդ սիթի» ՍՊ ընկերության տնօրեն Գևորգ Մաչանյանին:

Շնորհակալ ենք մեր բոլոր աջակիցներին և լիահույս ենք, որ այս անգամ ՀՀ դատախազությունը կիրականացնի պատշաճ հսկողություն և մեղավորներին մեղադրանք կառաջադրվի:
