ՀՀ Վերաքննիչ դատարանը բավարարել է ՀՀ գլխավոր դատախազի բողոքը և արդարացրել 2008թ. նախագահական ընտրությունների շրջանում կատարված իրադարձությունների կապակցությամբ քննված գործով դատապարտված Իսահակ Մալխասյանին:
Այս մասին ֆեյսբուքյան իր էջում հայտնել է ՀՀ գլխավոր դատախազի խորհրդական Գոռ Աբրահամյանը:
2008թ. հունիսի 16-ի դատավճռով Իսահակ Մալխասյանը մեղավոր էր ճանաչվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով՝ դատապարտվելով մեկ տարի ժամկետով ազատազրկման: Նրա նկատմամբ նշանակված պատիժը պայմանականորեն չէր կիրառվել՝ սահմանվելով մեկ տարի ժամկետով փորձաշրջան։
Դատավճիռը Ի.Մալխասյանի և նրա պաշտպանի կողմից բողոքարկվել էր ՀՀ վերաքննիչ քրեական դատարան, սակայն վերջինիս որոշմամբ Ի.Մալխասյանի և նրա պաշտպանի դատական նիստին չներկայանալու պատճառաբանությամբ վարույթը կարճվել է՝ վերաքննիչ բողոքից հրաժարվելու հիմքով:
ՀՀ գլխավոր դատախազության կողմից իրականացված՝ այս բնույթի գործերով դատավճիռների, քրեական գործերի նյութերի ուսումնասիրությամբ պարզվել է, որ նշված գործով 2008թ. մեղադրական դատական ակտ կայացնելիս Առաջին ատյանի դատարանը թույլ է տվել արդարադատության բուն էությունը խաթարող հիմնարար խախտումներ:
«Մ. Սաղաթելյանն ընդդեմ Հայաստանի Հանրապետության» և Հայաստանին չառնչվող մի շարք այլ գանգատներով Եվրոպական դատարանի կողմից արտահայտված իրավական դիրքորոշումների լույսի ներքո գնահատելով գործում առկա հանգամանքները՝ ՀՀ գլխավոր դատախազ Արթուր Դավթյանը դիմել էր ՀՀ վերաքննիչ քրեական դատարան՝ միջնորդելով բեկանել Ի. Մալխասյանի վերաբերյալ կայացված դատական ակտը և ճանաչել վերջինիս անմեղությունն իրեն մեղսագրված արարքներում:
ՀՀ վերաքննիչ դատարանը, քննության առնելով ՀՀ գլխավոր դատախազի բողոքը, երեկ կայացրած իր որոշմամբ ամբողջությամբ բավարարվել է այն:
